At the end of mining activities, and when this impound- <br />ment is removed when no longer needed or required, the point of <br />storage of these water rights will then be located in another <br />reservoir in the North 1/2 of Section 13, Township 4 North, Range 87 <br />West that is owned by Energy Fuels within Eckman Park in the <br />vicinity of the original reservoir. This reservoir will not be <br />disturbed by mining. As detailed under Section 780.21, Energy <br />Fuels does not anticipate injury to any other water rights as a <br />result of the proposed mining operations. <br />Section 816.55 Hydrologic balance: Discharge of water into an <br />underground mine. <br />Surface water shall not be diverted or otherwise discharged into under- <br />ground mine workings, unless the person who conducts the surface mining <br />activities demonstrates to the regulatory authority that this will -- <br />(a) Abate water pollution or otherwise eliminate public hazards re- <br />sulting from surface mining activities; and <br />No surface water will be diverted or otherwise discharged into <br />any underground mine workings, due to the fact that there are no <br />underground mine workings in the mine plan area. See Eckman Park <br />Mine Plan Map (Flap 2) and Energy Mines No. 1 and 2 !fine Plan <br />Dfap (E4ap 1) . <br />(b) Se discharged as a controlled flow, meeting the effluent limi- <br />tations of Section 816.42 for pH and total suspended solids, except that <br />the pH and total suspended solid limitations may be exceeded, if approved <br />by the regulatory authority, and is limited to coal processing waste, <br />fly ash from a coal-fired facility, sludge from an acid mine drainage <br />treatment facility, flue gas desulfurization sludge, inert materials <br />• used for stabilizing underground mines, or underground mine development <br />wastes. <br />816-65 <br />
