Section 81E.52 (b) Continued. <br />(2) After disturbed areas have been regraded and stabilized according <br />to this Part, the person who conducts surface mining activities shall <br />monitor surface water flow and quality. Data from this monitoring may <br />be used to demonstrate that the quality and quantity of runoff without <br />treatment is consistent with the requirements of this Part to minimize <br />disturbance to the prevailing hydrologic balance and attain the approved <br />postmining land use. These data may also provide a basis for approval <br />by the regulatory authority for removal of water quality or flow control <br />systems. <br />(3) Equipment, structures, and other devices necessary to measure and <br />sample accurately the quality and quantity of surface water discharges <br />from the disturbed area shall be properly installed, maintained, and <br />operated and shall be removed when no longer required. <br />The proposed surface mining monitoring plan including monitoring <br />• required for NPDES Permit No. CO-0027154 (see Exhibit 17, NPDES <br />_~ Permit) described and scheduled in Section 780.21, will be fully <br />adequate to measure and record the quantity and quality of all <br />discharges from the permit area. The frequency, density and <br />accuracy of monitoring will allow Energy Fuels to evaluate and <br />determine the success of mine plans, treatment facilities and <br />reclamation methods for the purpose of minimizing disturbance to <br />the hydrologic balance and attaining the postmining land use. The <br />plan submitted under Section 780.21 covers the operations, recla- <br />mation and postmining phases of hydrologic monitoring. Ponitoring <br />of surface water quantity and quality will be achieved with the <br />best technology currently available in monitoring techniques and <br />facilities. Since Energy Fuels reports on discharge in accordance <br />with the Clean Water Act of 1977 under a NPDES permit every quarter, <br />Energy Fuels will use the alternative procedure of notif}•ing the <br />regulatory authority of the report filing on the same time schedule <br />as required by the NPDES permit.
