Permanent runoff control <br />structures must be large enough to hold a 100-year storm, and as it <br />exists now, it is too small. Will other structures be used during <br />mining or reclamation? <br />The powerline is still shown as passing through the proposed site. <br />We still have not received information from you regarding either a <br />setback of a full 200 feet from the base of each pole, or an <br />agreement with the owner for potential damage to that structure. <br />Please provide us with the name of the owner of that structure. <br />EXHIBIT D <br />As described, mining will proceed by "zones." Are these the same <br />as the "phases" shown on the map? What is the approximate number <br />of acres in each zone? <br />The bond will depend on the amount of total disturbance at any <br />point in time during operation. How soon after the mining in a <br />zone is completed, will reclamation begin? What will be the <br />expected number of acres during the life of the mine, that will be <br />in a state of major, moderate or minor disturbance? This is <br />required pursuant to Minerals Rule 6.4.4, and disturbances defined <br />in Rule 1. <br />You describe the buffer zone as being around the perimeter of the <br />property, rather than defining it as along the permit boundary. I <br />assume that you meant to write "permit boundary" instead of <br />"property" boundary. Please clarify this. <br />EXHIBIT E <br />The shrub information you submitted to complete the seed mix is <br />satisfactory. Will shrub seed be applied with the grass seed, or <br />separately? This additional information will be added to the <br />originally submitted grass seed information. <br />Your reclamation plan now states that approximately four inches of <br />topsoil will be replaced before seeding. Where shale layers exist, <br />approximately 12 inches of overburden will be replaced before <br />topsoiling. <br />EXHIBIT F <br />Please provide your updated reclamation map as soon as you can. <br />EXHIBIT G <br />I have spoken to the water engineer who is working on designing the <br />correct sediment and runoff control plan for the site. He <br />understands that if the existing dam is to remain, it must be large <br />enough to contain a 100-year event. He is going to provide us data <br />
