i• <br />Application of Bowie Resources, LLC <br />Case No. 02CW77 <br />Ruling of Referee and Decree <br />Page 8 <br />14. Statement of Plan for Augmentation: <br />A licant's Water Re uirements and De letions <br />A. Applicant owns the Bowie No. 1 Mine, located in Sections 23 and 24, T. <br />13 S., R. 92 W., 6th P.M., which is no longer operational. Applicant also owns and operates the <br />Bowie No. 2 Mine, the portal of which is located in Section 10, T. 13 S., R. 91 W., 6th P.M., <br />Delta County, Colorado. The mines are located in the North Fork of the Gunnison River Basin. <br />The location of the mines are shown on Figure 1, attached hereto. The mines are underground <br />coal mines. The Bowie No. 2 Mine includes processing and shipping facilities related to its coal <br />mining operations. The water rights and augmentation plan described in this Application will be <br />used in connection with the operation of the Bowie No. 2 Mine, as well as to augment <br />evaporative depletions from the Bowie Sedimentation Ponds, described in the Findings Re: First <br />Claim for Relief, above. <br />B. In connection with its operations of the Bowie No. 2 Mine, Applicant uses <br />water both for industrial and domestic purposes. Water for these purposes is pumped from the <br />Deer Trail Ditch under Applicant's Deer Trail Industrial Right and placed in a 500,000 gallon <br />storage tank, from which point it is distributed to its place of use. A flow meter on the delivery <br />pipeline is used to measure total diversions. Applicant's industrial and domestic uses are <br />summarized as follows: <br />i. The majority of Applicant's water needs in connection with its <br />operations of the Bowie No. 2 mine are for industrial purposes directly associated with the <br />mining of coal. Diversion records show that Applicant's industrial water use averages about 10 <br />gallons per ton of product. At the production rate of 6 million tons per year, Applicant annually <br />diverts approximately 184.11 acre feet in connection with its mining operations. Applicant <br />consumes an estimated 90% of the water diverted, either by evaporation or as retained moisture <br />in the coal. The other 10% either returns to the system by infiltration or is collected in the ponds <br />[hat are the subject of the augmentation plan decreed in Case No. 99 CW 263. Because <br />Applicant's depletions aze generally the same each month of the yeaz, the portion of this 10% that <br />returns to the system by infiltration is generally the same each month of the year and delayed <br />depletions do not need to be addressed. Total annual mining depletions are approximately <br />165.70 acre feet. <br />ii. Applicant's domestic water use in connection with the operation of <br />the Bowie No. 2 Mine varies between 4,000 and 5,000 gallons per day (gpd). This amount of <br />water use is equivalent to approximately 18 to 23 gpd per employee, which amount is consistent <br />with other similar operations in which shower facilities are provided.
