Application of Bowie Resources, LLC <br />Case No. 02CW77 <br />Ruling of Referee and Decree <br />Page 7 <br />aze described on Table 2, attached hereto. The Class 1 shazes entitle Applicant to 1.13 c.f.s. of <br />the 1.25 c.f.s. decreed to Deer Trail Ditch, priority 25. <br />B. Applicant owns or controls 10.5 shazes of the capital stock of the North <br />Fork Farmer's Ditch Association ("Farmer's Ditch Association"). The Farmer's Ditch <br />Association has 220 shares outstanding. Accordingly, Bowie owns 4.8% of the Farmer's Ditch <br />Association shares. The Farmer's Ditch Association owns water rights adjudicated to the North <br />Fork Farmer's Ditch. These water rights aze described on Table 3, attached hereto. <br />C. The Applicant holds along-term lease fora 25% interest in the East <br />Beckwith Reservoir No. I, which entitles it to the release of 95.75 acre feet of water. The water <br />rights for the East Beckwith Reservoir No. 1 are described as follows: <br />i. Decree Information: Decree entered May 28, 1937, Case No. 2563, <br />Delta County District Court. <br />ii. Legal description of place of storage: Located in Section 3, T. 14 <br />S., R. 88 W., 6th P.M., the initial point of survey of said reservoir <br />being at a point whence the Southeast Comer of Section 34, T. 13 <br />S., R. 88 W., 6th P.M., beazs N. 31 ° 57' E. 1627.2 feet distant. <br />iii. Source: Anthracite Creek, tributary to the North Fork of [he <br />Gunnison River. <br />iv. Amount: 568.8 acre feet absolute and 277.2 acre feet conditional. <br />Subsequently, the conditional portion and 185.8 AF of the absolute <br />portion were abandoned, leaving a total of 383 AF absolute. <br />v. Appropriation Date: September 1, 1934. <br />vi. Decreed use: Irrigation. <br />D. Augmentation water will also be provided by water released from Blue <br />Mesa Reservoir under a water service contract to be obtained by Applicant.- Blue Mesa Reservoir <br />(Wayne N. Aspinall Unit of the Colorado River Storage Project) was decreed 939,204 acre feet <br />in C.A. Nos. 5590 and 6981, Gunnison County District Court, with a November 13, 1957 <br />appropriation date. An additional 124,253 acre feet, with the same appropriation date, was <br />transferred to the Reservoir in C.A. No. 10045. The initial point of survey of Blue Mesa Dam is <br />located at a point on the right abutment being the intersection of the center line of the axis of the <br />dam and the center line of the outlet works tunnel, whence the SW corner of Section 31, <br />Township 49 North, Range 4 West, N.M.P.M. bears North 78°36'44" West a distance of 3,207.07 <br />feet. <br />
