Application of Bowie Resources, LLC <br />Case No. 02CW77 <br />Ruling of Referee and Decree <br />Pagel l <br />results in a credit of 0.41 AF for every 1.0 AF of water released from the Reservoir. <br />Alternatively stated, 2.44 AF of water must be released from the Reservoir to replace 1.0 AF of <br />depletions. <br />v. Pursuant to Sections 37-83-101, 37-83-104, and 37-87-102(4), <br />C.R.S., the Division Engineer may adjust the transit losses for water released from East Beckwith <br />Reservoir if necessary to prevent injury to vested senior water rights. However, because the <br />recent Wright Water Engineers, Inc., transit loss study determined the appropriate loss from the <br />Reservoir to Somerset under present conditions, an adjustment to the transit loss shall not be <br />made unless there is a substantial change in stream conditions, or unless a subsequent transit loss <br />study conclusively determines that a different transit loss factor should be used. Prior to <br />adjusting the transit losses, the Division Engineer shall notify the Applicant and provide the <br />Applicant the opportunity to offer data and other input regazding whether the transit loss factor <br />should be adjusted. <br />H. Applicant has applied for a contract for water from Blue Mesa Reservoir, <br />to provide additional augmentation water for use in this plan. A 5% transit loss wilt be applied <br />from Blue Mesa Reservoir to the confluence of the Gunnison River with the North Fork of the <br />Gunnison River. <br />Augmentation Plan <br />I. The Deer Trail Industrial Right and the Bowie Sedimentation Ponds are <br />potentially subject to calls from downstream senior water rights, as follows: <br />i. The Deer Trail Industrial Right maybe subject to call from senior <br />irrigation water rights located downstream of Applicant's operations on [he North Fork of the <br />Gunnison River from July 1 through October 31 of each year (herein Che "Imgation Season Call <br />Period"). In addition, Applicant may be required to augment or replace its evaporative depletions <br />from the Bowie Sedimentation Ponds during the Irrigation Season Call Period to satisfy the call <br />of the downstream senior imgation water rights. Although the ponds are primarily sedimentation <br />structures that mayor may not contain any quantities of water at any given time, Applicant has <br />assumed that augmentation or replacement for the ponds will be required during the entire <br />Irrigation Season Call Period. ' <br />ii. The Deer Trail Industrial Right and the Bowie Sedimentation <br />• Ponds may also be subject to call by senior water rights on the Gunnison River neaz Grand <br />Junction during any time of the year. This call shall be referred to herein as the "Redlands Call." <br />
