Application of Bowie Resources, LLC
Case No. 02CW77
Ruling of Referee and Decree
Page 10
F. Applicant owns or controls 10.5 shares of the capital stock of the Farmer's
Ditch Association. Applicant has historically used the water diverted under these shares to
irrigate approximately 30 acres of orchazds neaz Bowie. The consumptive use attributable to the
water diverted under these shares is 1.60 acre feetlacre for 30 acres, or 48 acre feet per yeaz.
Applicant will dedicate the consumptive use associated with approximately 12.1 acres, or 19.48
acre feet, to this augmentation plan (the "Farmer's Ditch Depletion Credits"). The Water
Balance attached hereto as Table 6 shows the Farmer's Ditch Depletion Credits spread over the
irrigation season.
G. In addition to the Deer Trail Depletion Credits and the Farmer's Ditch
Depletion Credits, Applicant controls storage rights in the East Beckwith Reservoir No. 1 that
may be used in connection with this augmentation plan. Applicant is the lessee of a 25% interest
in the East Beckwith Reservoir No. 1, which entitles it to the release of 95.75 acre feet of water.
• i. In Case No. W-3106, 74 acre feet of Applicant's share of the East
Beckwith Reservoir No. 1 water was changed to industrial use and dedicated to a separate
augmentation plan to augment depletions from Orchard Valley Wells Nos. 1, 2, 3 and 4 (the
"Orchard Valley Wells"). The Orchard Valley Wells and the augmentation plan decreed in Case
No. W-3106 are now owned by Applicant. The Orchard Valley Wells were used to supply water
to the Orchard Valley Mine, operated by a predecessor of Applicant. The Orchard Valley Mine
is no longer in operation, and the Orchard Valley Wells are currently being used only for limited
purposes. Accordingly, the entire 74 acre feet of East Beckwith Reservoir No. 1 water is no
longer needed to augment the Orchard Valley Wells, and Applicant will utilize al] or a portion of
that water for augmentation purposes in this case. The cumulative use of this augmentation
source will not. exceed 74 acre feet in this case and for any remaining uses in Case No. W-3106.
ii. In Case No. 99CW263, Applicant dedicated 4.59 acre feet of its
rights in the East Beckwith Reservoir No. 1 to be used for augmentation.
iii. Accordingly, Applicant has a total of up to 91.16 acre feet of water
from its interest in East Beckwith Reservoir No. I that it can use for augmentation purposes
(95.75 acre feet attributable to its 25% leasehold interest, less 4.59 acre feet dedicated in Case
No. 99CW263).
iv. The Division Engineer has determined that a transit loss of 10%
and an efficiency factor of 46% should be applied to releases from the East Beckwith No. 1
• Reservoir. The transit loss factor is based upon a study recently conducted by Wright Water
Engineers, Inc. for Applicant's predecessor and others, which study has been reviewed and
approved by the Division Engineer. Application of the above transit loss and efficiency factors
