Under Exhibit B the operator stated that there will be no toxic or acid forming materials <br />exposed or disturbed as a result of mining operations. Under Exhibit C however, <br />operator states, "In [he very unlikely situation where this mine should produce acid or <br />toxic producing materials, [hey would be backfilled into a previously mined area in the <br />permit." Which of the statement is true? If the operator, though highly unlikely based <br />on the amount of disturbance, anticipates the generation of acids or toxic drainage, <br />operation will have to be a designated mining operation. However, the Division does no[ <br />believe this to be true so please remove the statement from Exhibit C page t 1. <br />III. Under Exhibit C page 10 the operator states, "Waste rock would be stacked behind the <br />backhoe or transported to an adjacent area where the general public could sort for bits <br />of turquoise." <br />All areas associated with [his operation has to be within the permit area. Please identify the location of <br />this adjacent area on [he mining and reclamation map. <br />EXHIBIT D -Reclamation Plan <br />The overall reclamation plan is to replace the excavated materials back into the pit slopes <br />that would be similar to the pre-mining surface. Operator estimates the size of the pit <br />to be 150' x 100' x 50'. If this is going to be the final configuration of the pit the <br />material to back fill this pit will be approximately 27,000 cubic yards even at 55 degrees <br />mining plan. Based on the mining plan and the pre-operational inspection of the site <br />disturbed, this size appears to be a bit excessive and would require the Division to <br />estimate a financial warranty that far exceeds the one calculated by the operator please <br />double check your figures and submit an updated reclamation plan using the maximum <br />disturbance that would be in place at anytime during the life of the operation. <br />The Division's decision date for the application is December 2, 1996.
