There are numerous
items which must be answered or clarified [o meet the requirements of the application, as I have indicated below.
Portions of the application not mentioned herein are considered adequate at [Iris time and do not require a response.
My questions are arranged in the order of the application item number or exhibit to which they pertain. Please
arrange and label your responses similarly to facilitate their review and inclusion into the application.
Application Item 3 -Permitted Acreage
This item states that 240 acres is the total acreage applied for under this permit application. This figure does not
match the acreage stated on the maps nor what is described in the legal description. Either this item or the other
acreage references must be revised so that all figures in this application correspond. If this item is revised, another
application page should be submitted. Further mention is made of this discrepancy under the respective headings
below.
Aoolication Item 7. I -Names of the Holders of anv Recorded Easements on the Affected Land
The application states that there are no holders of recorded easements, a statement which the Division can accept as
an adequate response. The pre-mining map (in Exhibit C), however, depicts several structures which may actually
lie within such easements, though that fact is not known at this time. The structures which may be located within
recorded easements include: overhead electric powerline, telephone line, natural gas pipeline, possible extension of
County Road 2E (though unconstructed or public accessibility limited), and various ditches. If recorded easements
exist for any of the above-named structures, or others, please name their owners of record under this application
item, and provide the additional required information elsewhere in [he application, including depiction on die
appropriate maps.
Exhibit A - Legal Description
The metes and bounds description appears correct, thollgll I would insert the word "East" as the second word of the
next-to-last line, ilt order to more clearly close the traverse. This traverse describes a parcel of exactly 219.706
acres, which does not match the 240-acre figure noted above, though it closely approximates [he 220-acre figure
shown on the maps. This exhibit's acreage figure must correspond to those found elsewhere in the application, so
please revise this if necessary.
