EXHIBIT B <br />STAFF RECOMMENDATIONS• <br />The Development Agreement shall contain the following conditions of approval: <br />The following items are to be done before commencement of operation: <br />i. A detailed site plan signed and approved by the Applicant and County Planner is to be <br />attached to the Development Agreement and recorded in the Office of the Clerk and <br />recorder. <br />2. A noxious weed mitigation pion shall be submitted and approved by the Delta County <br />Weed Coordinator prior to issuance of the Development Agreement. The weed <br />mitigation plan shall also include the time frame to reclaim the site. <br />3. Provide a copy of the Colorado Department of Health and Environmental Fugitive Dust, <br />NPDES, SWMP, and MSHA to Delta County Planrnrtg Department as soon as they aze <br />issued. <br />4. Aa approved Delta County Health Department mosquito control plan by shall be <br />submitted. <br />5. A copy of any contract(s) between the Owner and Operator(s), if different than the <br />Owner, delineating the conditions outlined in the exhibit shall be provided to Delta <br />County prior to commencement of operations. <br />The following items are to be done daring the development: <br />1. All parking and loading shall be within the permitted area. <br />2. Crushing operation shall be stopped on windy days when dust is blowing from the <br />permitted area. <br />3. All crushing operations shalt be required to use spray bars to sprinkle water to retazd <br />dust. <br />4. Dust suppression shall be maintained on all internal haul roads and the stockpile, <br />crushing and processing areas at all times during hours of operation. Dust will not be <br />permitted to impact the surrounding property owners' residences, livestock, or crops. <br />5. Employees are not permitted to camp on site in recreation vehicles except for <br />allowing night watchmen. Sleeping in trucks is allowed in the processing or staging <br />area only. <br />6. Hours of operation shall be from 7 a.m. to 5:30 pm, and approval from the Board of <br />County Commissioners must be obtained to approve hours of operation on Saturdays, <br />or Sundays and extended hours of operation on Monday- Friday. <br />7. No work shall be done on the following nationally recognized holidays: New Yeaz's <br />Day, Memorial Day, Fourth-of--July, Labor Day, Thanksgiving, and Christmas. <br />8. The Development Agreement will be effective only upon issuance of a permit for the <br />Benson Brothers to conduct surface extraction of constnrction materials and <br />reclamation from the State of Colorado, Division of Minerals and Geology. <br />9. All outside lighting shall be hooded. <br />10. The existing imgationditclies shall remain undisturbed (as stated in the application) <br />to insure flow of irrigation water to the water users. <br />11. Chemical toilets shall be allowed and shall be pumped and maintained in a sanitary <br />condition by a Delta County Licensed Contractor. <br />12. Residential mufflers shall be required on all pumps and generators. <br />13. An asphalt batch plant will be permitted and shall be located in the staging or <br />processing area for a limited time only.
