Tucker Page 2 <br />U.S. Department of Energy <br />Burros Mine, Permit No. M-77.297 <br />September 14, 1998 <br />address DOE desires in a manner which complies with the Act and Rules. <br />Modification of DOE requirements, as stated in DOE 8!20!98 correspondence, may <br />be necessary. <br />Explanation for Option #2 -DMG cannot approve modifications to the existing reclamation <br />plan which conflict with the Act and Rules. If the venthole cannot be backfilled or sealed, <br />it must be appropriately safeguarded and stabilized in accordance with 34-3 ~-10211) <br />C.R.S. and Rule 3.1.516). If an 80' section of the portal cut slope (40' radius from portal) <br />cannot be eliminated by backfilling and grading to match natural contours, it must be <br />stabilized in accordance with Rule 3.1.5(3) and 34-32-116(7-(h) C.R.S. if the mine road, <br />providing access to the Burros portal and venthole, cannot be reclaimed, if must be <br />stabilized in accordance with Rule 3.1.5(1) and (31, and 34-32-116(7-(a) and (h). <br />Additionally, the post mining land use may have to be altered, in accordance with Rule <br />3.1.1, for portions of the affected lands which will not be reclaimed to supp~xt rangeland <br />and wildlife habitat, as currently approved in the reclamation plan. <br />3. Complete reclamation in accordance with the existing reclamation plan for affected <br />Lands not addressed by DOE imposed requirements. Petition the Colorado Mined <br />Land Reclamation Board for reclamation of substituted land, as providf~d under Rule <br />3.1.2 and 34-32-11617)(g1(III) C.R.S., for affected lands addressed by DOE imposed <br />requirements and therefore not reclaimed.
