Long <br />Division Director <br />RE: Reclamation of Burro Tunnel Site, DOE Lease Tract C-SR-13, <br />Burros Mine, DMG Permit No. M-77-297. <br />Dear Mr. Tucker: <br />On 8/24/98, the Colorado Division of Minerals and Geology (DMG) received copy of DOE <br />correspondence, addressed to Umetco Minerals Corporation, dated 8/20/98, regarding <br />reclamation requirements imposed by DOE for the Burros Mine. <br />DMG met with Umetco personnel at the Burros Mine on 8/18!98. Please find enclosed, <br />copy of the DMG inspection report resulting from the 8/18/98 meeting and inspection. <br />Sections of the Act referenced within this letter are taken from the Colorado Mined Land <br />Reclamation Act, 34-32-101 Qt seo•, C.R.S., revised 7/93. Rules referenced within this <br />letter are taken from the Hard Rock/Metal Mining Rules and Regulations of the Colorado <br />Mined Land Reclamation Board, amended 10/95. <br />As noted in the enclosed inspection report, some of the DOE requirements ~Ippear to <br />conflict with conditions of the approved reclamation plan for the Burros Mine. DMG has <br />identified the following three options, available to Umetco, whereby Umetco is not <br />prevented from completing site reclamation per the terms of their approved state <br />reclamation permit and may ultimately secure release of warranties and terrtlination of <br />permit. <br />1. Transfer the permit to the party desiring to utilize the permit area for mining <br />purposes. <br />Explanation for Option #1 -Should GEMI desire to conduct a mining operation at the <br />referenced site, a reclamation permit is required under 34-32-109 C.R.S. Rule 1.12 and <br />34-32-119 C.R.S. provide opportunity for transfer of the existing DMG perrtlit to GEMI as <br />successor operator. <br />2. Modify the existing reclamation plan through the Technical Revision process to <br />
