Burden of Proof Requirements <br />The pertrSnet bas the burden of proof when requesting relief from total suspended solids (TSS), total iron <br />and/or senleable solids limitations. Relief steal] be granted only when necessary and shall no[ be granted <br />when the perminee has control over the discharge. The perminee should endeavor to meet the primary <br />]imitations whenever possible. The Division shall have final authoriry in determining whether relief is <br />granted. <br />1) For rainfall to waive TSS and [oral iron limitations, it is necessary to demonstrate that discharge <br />occurred within 48 hours after measurable precipitation has stopped. To waive se[tleable solids <br />limitatiotts, it is necessary to prove that discharge occurred within A8 hours after precipitation greater <br />than the 10-year, 24-hour event has sropped. <br />2) For snowmelt, to waive TSS and total iron ]imitations, it is necessary to demonstrate that discharge <br />occurred within 48 hours after pond inflow has stopped. To waive senleable solids ]imita[ions, it is <br />necessary to prove that dischazge occurred within 48 hours after pond inflow volume greacer than the <br />10-year, 24-hour event has stopped. <br />The Division shall determine the adequacy of proof. As pan of this determination, the Division shall <br />evaluate whether the petmiaee could have controlled the discharge in such a manner that primary limitations <br />could have been met. All manual dewateting of ponds that are equipped with automatic dewatering systems <br />must meet TSS and total iron limitations. If a pond has only manual dewatering capability, relief is <br />available only [o the extent reouired to regain necessary srabiliry and capacity. <br /> <br /> <br />See Part I.C. for Definitions <br />
