Proposed Decision PR-4 <br />Please refer to Findings Documents of June 15, 2001 and May 2, 2003, respectively, for RN-3 <br />and PR-3 Proposed Decision narrative. <br />The Colorado Division of Minerals and Geology proposes to approve with stipulations the <br />application for Permit Revision No. 4 to revise surface coal mining operations at the <br />Seneca II-W Mine. <br />The application was submitted by Seneca Coal Company. This decision is based on a <br />fording that the operations will comply with all requirements of the Colorado State <br />Program as found in the Colorado Surface Coal Mining Reclamation Act, C.R.S. <br />34-33-101 et seq., and the Regulations promulgated pursuant to the Act. If no request for <br />a formal hearing is made within thirty (30) days of the first publication of the issuance of <br />this proposed decision, then this decision becomes final. Upon submittal of acceptable <br />surety by the applicant, the decision will become effective. The revision application, all <br />supporting documentation and any stipulations or conditions will become a binding part of <br />the permit. <br />Stipulations attached to Permit Revision No. 4 <br />STIPULATION 34 <br />THE PERMITTEE WILL SUBMIT PROPERLY AMENDED EXHIBITS 3-1, 3-2, 3-3, <br />AND 3-4 BY MARCH 1. 2005, AS PART OF A COMPLETE TECHNICAL REVISION <br />APPLICATION. THE EXHIBITS WII,L BE PROPERLY CERTIFIED IN ACCORDANCE <br />WITH RULE 2.10.3(2). <br />STIPULATION 35 <br />THE SEGMENT OF HAUL ROAD "A" EXTENDING TO THE EAST OF THE HAUL <br />ROAD "H" JUNCTION WII,L BE FULLY REGRADED TO APPROXIMATE ORIGINAL <br />CONTOUR (AOC) BY SEPTEMBER 1. 2005, UNLESS A TECHNICAL REVISION <br />APPROVAL FOR A MODIFIED ROAD DESIGN FOR POSTMINE USE IS APPROVED <br />BY THE DIVISION PRIOR TO THAT DATE. IF AN AMENDED DESIGN FOR <br />POSTMINE USE IS APPROVED BY THE DIVISION, THE DESIGN WILL BE <br />IMPLEMENTED AND COMPLETED BY SEPTEMBER 1. 2005. <br />STIPULATION 36 <br />A PROPERLY CERTIFIED AND AMENDED EXHIBIT 20-1A WILL BE SUBMITTED <br />TO THE DIVISION AS PART OF A COMPLETE TECHNICAL REVISION <br />APPLICATION, BY MARCH 1, 2005. THE AMENDED EXHIBIT WILL INCLUDE <br />Seneca II-W Findings Document 4 November 17, 2004 <br />Permit Revision No. 4 <br />
