within one year of completion of the £nal grading of adjacent backfill slopes, <br />and prior to topsoiling of areas adjacent to the channel. Following <br />construction, the channel will be left untopsoiled to allow for initial stabilization <br />and inspected for stability according to the rill and gully plan in Tab 22. When the <br />channels have been stabilized, the non-riprapped segments will be topsoiled and <br />vegetated. <br />Seneca Coal Company has permitted permanent and temporary stock pond <br />impoundments in both the reclaimed drainage channels at the Seneca lI-W Mine <br />and some existing culvert outlets. The stock ponds will slow the peak runoff of <br />precipitation events and help to minimize erosion in the drainage channels. They <br />will also act as additional alternate sediment control measures, minimizing the <br />potential for sediment from roads to be carried off the permit site. These small <br />ponds will benefit both livestock grazing and wildlife utilization of the reclamation. <br />Additional information regarding stock pond construction, including stability <br />analysis documentation based on worst case embankment geometry <br />assumptions, was incorporated into the application by TR-48 and PR-4 <br />amendments. Certain information requested by the Division during the PR-4 <br />review was not provided prior to issuance of the proposed decision. These <br />requests related to pre-construction design for individual stock ponds and <br />professional engineer certification of stock ponds following construction. The <br />following stipulations are attached to the PR-4 groposed decision. <br />STIPULATION 37 <br />PRIOR TO CONSTRUCTION OF ADDITIONAL STOCK PONDS, THE <br />PERMITTEE WILL SUBMIT AND OBTAIN DIVISION APPROVAL OF <br />INDIVIDUAL STOCK POND DESIGNS DEMONSTRATING <br />COMPLIANCE WTTH APPLICABLE REQUIItEMENTS OF RULE <br />4.05.9. SUCH DESIGNS WILL BE INCLUDED WTTHIN A COMPLETE <br />TECHNICAL REVISION APPLICATION OR APPLICATIONS. <br />STIPULATION 38 <br />BY DECEMBER 1, 2004, THE PERMITTEE WII,L SUBMIT <br />CONSTRUCTION CERTIFICATION BY A QUALIFIED REGISTERED <br />PROFESSIONAL ENGINEER FOR EACH EXISTING STOCK POND <br />IMPOUNDMENT, AND THE PERMITTEE WILL COMMTT TO <br />SUBMITTAL OF P.E.
