miles of the Tie Across Haul Road ('I'AHR) was constructed from the Hayden <br />Power Station to Routt County Road 53. Mine Area haul roads are depicted on <br />Exhibits 12-2, 12-3, 13-2 and 13-2A. As-built certifications for haul roads not <br />within the sediment control disturbed area and the design plans for all haul roads <br />are presented in Tab 13. <br />The culvert designs in the permit depict several multiple culverts for a road <br />crossing. In all cases where the multiple culverts are used, the combined end areas <br />are greater than 35 square feet. Rule 4.03.1(4)(e)(i) requires all culverts with end <br />areas greater than 35 square feet be designed to convey flows from the <br />20-year-24-hour storm. The applicant has complied with this regulation. <br />The applicant has proposed that certain haul road segments be retained in <br />reduced configuration for post-mining ranch roads, with other haul roads to <br />be reclaimed to AOC and revegetated. Those road segments proposed to be <br />reduced to a 20 foot travel width to replace pre-existing ranch roads include the <br />Mine Entrance Haul Road (MEHR), and segments or all of Haul Roads A, G, F, <br />H, J and K. The applicant has also proposed and submitted designs for a <br />permanent access road (the Ridgeline Access Road), to connect Road G with <br />proposed permanent road segments in the reclaimed "A" Pit area and the <br />South Extension Area. <br />Based on review of Technical Revision 42 (TR-42), the Division determined <br />that written landowner requests required by Rules 4.03.1(1)(f)(ii) and <br />4.03.2(1)(g)(ii) had not been provided for various haul road and access road <br />segments proposed for permanent retention. The following stipulation <br />(Stipulation 32) was attached to the Division's approval decision for TR-42, <br />and the stipulation remains in effect. <br />STIPULATION 32 <br />FOR PERMANENT ROAD RETENTION ON RECLAIMED LANDS, THE <br />PERMTTTEE WILL SUBMIT, WITHIN A COMPLETE REVISION <br />APPLICATION, DEMONSTRATION OF COMPLIANCE WITH 4.03.1(1)(f) <br />OR 4.03.2(1)(8) AS APPLICABLE. THE DEMONSTRATION WH.L <br />INCLUDE COPIES OF SIGNED LANDOWNER REQUESTS FOR ROAD <br />RETENTION FROM EACH AFFECTED LANDOWNER. ALL ROADS OR <br />SEGMENTS OF ROADS REQUESTED FOR RETENTION WILL BE <br />IDENTIFIED CONSISTENT WITH DESIGNATION IN THE PERMTT <br />APPLICATION (HAUL ROAD G, RIDGELINE ACCESS ROAD, OIL <br />WELL ACCESS ROAD, ETC.). THE ROAD RETENTION <br />DEMONSTRATION WILL BE SUBMTTTED TO AND APPROVED BY THE <br />DIVISION PRIOR TO APPROVAL OF PHASE 1 BOND RELEASE FOR <br />Seneca II-W Findings Document 20 November 17, 2004 <br />Permit Revision No. 4 <br />
