Cottony <br />Division Director <br />Steamboat Springs, CO 80477 Natural Resource Trustee <br />Re: Hayden Gulch Loadout, Permit C-1992-081, Coal Bond Compliance Inspection <br />Dear Mr. Weinman: <br />The Colorado Division of Reclamation, Mining and Safety (Division) has completed a <br />coal bond compliance inspection of the Hayden Gulch Loadout. A copy of the report <br />(form) is attached. Please respond to the following items with a revision(s) to the Permit <br />Application Package (PAP). <br />Item I. With reference to the introduction of the report, the PAP was found to not contain <br />clearly defined general (Rule 2.05.2) or specific (Rule 2.05.3) operation plans for the site. <br />Please develop and incorporate such plans into the PAP. A question that arose is: "What <br />is the currently approved operation -coal load in, or coal load out? Or both?" Please <br />formulate the plans to clearly define the permitted operations(s). <br />Item 2. The current reclamation cost estimate does not include the removal of some of the <br />fences, gates, interior light poles, signage, and the remnant stacker-tube coal pad (coal). <br />Please incorporate the demolition (removal) of these items in the reclamation cost <br />estimate. <br />Item 3. Please correct the statement on page 5 of Tab 13 of the PAP that states that wells <br />HGDALI and HGDAL2 were abandoned in accordance to the rules and regulations of <br />the Colorado Division of Water Resources. Although monitoring at these sites has <br />ceased, the wells have not been abandoned in accordance with the regulations (note that <br />the wells need to be abandoned in accordance with Rule 4.07.3 as well). <br />Item 4. Please file a copy of the abandonment (completion) reports for Shallow Well No. <br />l and Well 22772F with the Division. From experience (with Phase 1[I bond releases), <br />the Division recommends that well abandonment reports for the site be placed in an <br />appendix or exhibit of [he PAP [a finding is required that all wells (eta) have been <br />sealed]. <br />Item 5. The removal of Yampa Valley Electric Association, Inc. (YVEA) power lines and <br />the substation at the site are, in a lease agreement, at the option of the YVEA (Tab 3, <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction Durango Active and Inactive Mines <br />
