Stipulation No. 14 was attached to Technical Revision No. 21, issued March 6, 1995- The stipulation <br /> required submittal of an air emission permit prior to construction of the North Portal coal handling facilities <br /> addressed in the revision. A copy of the emission permit dated June 27, 1995 was submitted to the Division, <br /> and is included in Appendix 16-1 of the permit application. The stipulation was terminated by PR-02. <br /> Stipulation No. 15 was attached to the September, 1997 permit transfer. The stipulation required proof of <br /> resolution of certain Kentucky and West Virginia violations listed in the AVS system at the time of issuance <br /> of the transfer decision. Documentation of final resolution was provided within Technical Revision No.25, <br /> and the stipulation has been terminated. <br /> Stipulation No. 16 required a revised wildlife habitat map. The map was provided within Technical <br /> Revision No. 27,and the stipulation has been terminated. <br /> Stipulation No. 17 required a plan for surface rock replacement on reclaimed areas. The plan was <br /> provided within Technical Revision No.27,and the stipulation has been terminated. <br /> Stipulation No. 18 required relevant showing statements in lieu of certification for various haul road <br /> and access road segments. The required statements were submitted within Technical Revision No. 27, <br /> and the stipulation has been terminated. <br /> Stipulation No. 19 required permanent channel designs, for a channel to be constructed upon final <br /> reclamation at the south end of the Roadside Refuse Disposal Area. The design was submitted within <br /> Technical Revision No.27,and the stipulation has been terminated. <br /> Stipulation No. 20 required certifications for a Light Use Road 1 Ditch segment, and the South <br /> Diversion Ditch,above the Roadside Refuse Disposal Area. The certifications were submitted within <br /> Technical Revision No. 27,and the stipulation has been terminated. <br /> Stipulation No. 21 required submittal of a final air emission permit for CRDA-1,and required that the <br /> air emission permit for CRDA-3 be submitted prior to initiation of waste disposal at the site. The final <br /> air permit for CRDA-1 was submitted within Technical Revision No. 27. The operator withdrew <br /> CRDA-3 from the permit via amendments associated with RN-03,making the section of the stipulation <br /> relating to CRDA-3 moot. As a result,the stipulation is terminated by RN-03. <br /> Stipulation No. 22 requires specific documentation to be provided prior to initiation of mining within <br /> the subsidence angle of draw beneath the 345 KV Rifle-San Juan Powerline,within the South Portals <br /> mining area. The stipulation remains in effect. <br /> Revisions Approved Since RN-02 Approval (July, 1993) <br /> One permit revision (PR-02), fifteen technical revisions (TR's), eleven minor revisions (MR's), and one <br /> Succession of Operator's (SO-1), have been approved since approval of RN-02.
