MR-35 approval decision was issued April 7, 1999. The revision changed the classification of a section <br /> of Access Road 3, to "Light Use", based on the nature of the road and the fact that it is used <br /> infrequently (once a week). <br /> MR-36 approval decision was issued February 22, 1999. The revision allowed for a limited expansion <br /> of the area approved for exploration mining within the "C" Seam, to allow the operator to further <br /> assess the potential for full scale mining of the seam. <br /> MR-37 approval decision was issued April 7, 1999. The revision addressed relocation of the rock dust <br /> bin to the North Portal facilities area,and designated a former evaporation pond at the North Portal <br /> as a storage area for construction dirt. <br /> MR-38 approval decision was issued April 19, 1999.The revision modified South Mine entrance gate <br /> drainage controls adjacent to the guard shack A grated ditch segment was replaced by a culvert and <br /> asphalt berm. <br /> MR-39 approval decision was issued June 8, 1999. The revision allowed for an 8 acre extension of the <br /> previously approved "C" Seam exploration mining area. <br /> MR-040 approval decision was issued October 12, 1999. The revision allowed for disposal of coal waste <br /> from the Bowie Resources Mine on CRDA-1 and CRDA-2,with the condition that a stability analysis <br /> would be performed if the tops of the piles exceed 9/23/99 surveyed elevations by more than 5 feet. <br /> Succession of Operators <br /> SO-I proposed approval decision was issued September 23, 1997, wherein Permit C-81-041 was transferred <br /> from Powderhorn Coal Company, a Peabody Holding Company subsidiary,to Powderhom Coal Company, <br /> a subsidiary of Quaker Western Coal Company. One condition, Stipulation No. 15, was placed on the <br /> approval decision. The stipulation required that proof of resolution of six Kentucky Civil Penalty Violations <br /> associated with Permit No. 8670201 and three Virginia CMIS violations associated with Permit No. 2850, be <br /> submitted to the Division as soon as available. <br /> Permit Renewal No.3 Review Process <br /> Powderhorn Coal Company(PCC)submitted an application for renewal of Permit C-81-041 (RN-03), <br /> on July 7, 1997. The submittal included a renewal application form, certificate of insurance, and <br /> proposed public notice. The application was deemed complete on July 17, 1997, and notices were <br /> provided to various local,state,and federal agencies on that date. Public notice of the application was <br /> published in the Grand Junction Daily Sentinel once a week for four consecutive weeks, beginning July <br /> 27, 1997. Copies of the application were filed with the Mesa County Clerk and Recorder's Office,and <br /> at the Denver and Grand Junction offices of the Division. Comments were received during the review <br /> period from the Army Corps of Engineers, the Bureau of Land Management (BLM), and the State <br /> Historic Preservation Officer(SHPO). The agency comments were forwarded to the operator. <br /> The Division's adequacy review was conducted with the following sequence of adequacy review letters, <br /> agency correspondence,and response submittals from PCC. <br /> 10 <br />
