A <br /> Stormwater discharge Permit will be acquired for the site from the Colorado Department <br /> of Health, Water Quality Control Division. <br /> 9. Vehicular access will be the historic use onto Mountain Shadows and then to Greenhorn Road. <br /> 10. The following additional permits will be acquired: <br /> a. Mined Land Reclamation Board Permit No. M-79-158 is being expanded to a <br /> 112 permit concurrent with this application. <br /> b. Water Quality Control Division Stormwater Discharge Permit. <br /> c. The permit is "grandfathered" by the Air Pollution Control Division. <br /> The Plot Plan and Vicinity Map show the location of the subject property. The A-1 Zone District, <br /> Uses by Review Section provides for "Natural Deposits Extraction and Processing." <br /> Section 36 - adjustment (f) appeal for a Special Use Permit provides: "Before granting an appeal for <br /> a Special Use, the Planning Commission shall find in writing, based upon evidence and testimony, <br /> that all of the following conditions do, in fact, exist." <br /> (1) "The requested use is listed as a Special Use in which the parcel is located." <br /> As stated in the preceding paragraph, the requested use is provided for in the A-1 Zoning District as <br /> "Natural Deposits, Extraction and Processing." <br /> (2) "The granting of the Special Use Appeal will not substantially modify the Land Use Plan <br /> or the intent, purposes and spirit of this resolution." <br /> The owner/applicant does not feel that this Special use will substantially modify the Land Use Plan <br /> or its intent or purpose since the same type activity has been taking place on this property for over <br /> 35 years. It supplies a need for both the operator and Pueblo County Public Works Department to <br /> help maintain the road system in this area. There is no indication at this time the rate of extraction <br /> will be increased any great amount. <br />
