Thomason: <br />This letter is written to formally notify you of inadequacies in your <br />recently submitted material. The following points should be addressed prior <br />to Board consideration: <br />~/1. Tl~e key question with respect to the access road whether or not it is a <br />public access road. The pertinent facie are as follocva: <br />A. The road in question serves to connect two parcels of affected land. <br />B. Use of the road ie restricted by a gate, guardhouse and security <br />guard. Access is permitted only upon presentation of proper <br />identification. <br />Clearly this rood is both "on-site" and private and as such must be <br />included as affected land. <br />~2. The parking-security area is neither shown on a map nor included in the <br />legal description of the affected land while it is included in the <br />~~ mining plan (11). <br />~ 3. Part B of the mining plan indicates no earth moving while the reclamation <br />plan includes the removal of "sail like material" from road right of ways <br />and the toe of the dump and the construction of a.sediment impoundment. <br />~~ 4. Two titan are referred to under moderate dieturbancea; however, they are <br />apparently not shown on map or referenced in the surface disturbance list. <br />The preface of reclamation plan deletes affected acreage in Section 24, <br />25 and the security-parking area. <br />(~` Six inches of soil-like material is an extremely marginal, if not totally, <br />inadegnate, amount of cover. Aa is the case of other oil shale operations <br />to twenty inches is generally required. <br />
