Proposed Decision <br />The Colorado Division of Minerals and Geology proposes to approve an application for renewal <br />of a valid, existing permit. There are two stipulations that have been carried over from previous <br />permitting actions that are still active. <br />St~i ulation No. 14 <br />Somerset Mining Company must submit a mine plan change to, and receive approval from, <br />all applicable state and federal agencies before pulling pillars from the B seam underneath <br />any unmined C seam areas with less than 1,500 feet of cover within Federal Coal Lease <br />COC-53510. <br />St~i ulation No. 16 <br />The operator will, pursuant to Rule 4.10.2(2)(b), submit to the Division as part of the <br />quarterly coal mine waste pile inspection report, compaction test results for that pile. <br />Testing will take place on an as-needed basis, depending on the rate a[ which the pile <br />receives coal mine waste, to ensure stability of the pile. <br />Note: Stipulation Nos. 1 through 13, No. I S and 17 were all previously complied with. <br />The application was submitted by Oxbow Mining, Inc.for the Sanborn Creek Mine. This <br />decision is based on a finding that the operation will comply with all requirements of the <br />Colorado State Program as found in the Colorado Surface Coal Mining Reclamation Act, C.R.S. <br />34-33-101 et seq., and the Regulations promulgated pursuant to the Act. If no request for a <br />formal hearing is made within thirty (30) days of the first publication of the issuance of this <br />proposed decision, then this decision becomes final. The permit renewal application, all <br />supporting documentation and any stipulations or conditions will become a binding part of the <br />permit. <br />
