<br />XXV. Miscellaneous Compliance - Rules 2.05.6(5), 4.02, 4.12, 4.19, 4.21, 4.2 <br />and 4.30 <br />The operation does not include any activities to which this section applies <br />other than compliance with the requirements for signs and markers. <br />The operation is in compliance with the requirements of this section. <br />XXVI. aerations on Land Subiect to Limitations or Prohibitions - Rules <br />2.03.7 and 2.10 <br />Information regarding operations on land subject to limitations or <br />prohibitions is found in Appendix A, Volume I of the permit application. <br />the Division finds that the permit area of the proposed operation is not <br />within: <br />1. An area designated unsuitable for mining; <br />2. An area under study for designation as unsuitable for mining; <br />3. Any lands subject to any prohibitions or limitations; <br />4. 100 feet of the outside right-of-way line of any public road; or <br />5. 300 feet of any occupied dwelling. <br />The operation is in compliance with the requirements of this section. <br />XXVII. Demonstration that Surface Coal Mining and Reclamation Operations <br />can be Feasibly Accomplished - Rule 2.07.6(2)(b> <br />Based on information contained in the permit application and other information <br />document, the Division finds that surface coal mining and reclamation can be <br />feasibly accomplished at the Canadian Strip Mine. Information demonstrating <br />the feasibility of the operation and reclamation plan is found in Section <br />2.05, Volume 1 of the permit appiication. <br />The operation is in compliance with the requirements of this section. <br />XXVIII. Compatibility with Anticipatzd Adjacent Operations - Rule <br />2.01.6(2)(1) <br />Immediately adjacent to the operations at the Canadian Strip Mine is the Marr <br />Strip Mine operated by Kerr Coal Company. Both mines employ similar mining <br />methods and mine the same upturned of the Sudduth Coal seam. The mining <br />performed by Wyoming Fuel Company has occurred south along the eastern flank <br />of the McCallum Anticline, while Kerr Coal Company operations are proceeding <br />north toward the nose of the Johnny Moore Syncline. That is, the operation's <br />are proceeding away from each other. The previous mining and current <br />reclamation operations in Pit i occur approximately one mile southwest of the <br />most southern extent of the Kerr Coal Company Marr Strip Mine. Neither mine <br />has any underground workings. There is no evidence which would indicate that <br />the operations at the Canadian Strip Mine are incompatible with any other <br />operation. <br />2a <br />~~.-~ v-2~-yi <br />
