BRL has applied for a partial Phase I bond release, designated SL-02, for the reclamation work that has been done at the Bowie No. 1 East Mine and the Bowie No. West Mine. The Division is still reviewing this bond release request. The train loadout includes a scale, a truck dump, three silos, two conveyors, and a loadout building linked to a rail spur. A small shop, sewage treatment and substation are also located at the site. Although mining has ceased, the unit train loadout is still being used occasionally. All facilities and coal handling structures aze in compliance with the rules and regulations. III. Hydrologic Balance -Rule 4.05 The drainage and sediment control system at the mine and loadout were reviewed for compliance with Rules 2.05.3(4) and 4.05. This information is briefly described on pages 27 to 40 and pages 48 to 50 of Rule 2.05. Substantial design detail can be found in Volumes 8 and 8A, Sheet 6, of the Bowie No. 1 West Mine design specifications, Volume 6, Map 6A-2C of the Waste Disposal Appendix, and Map 6A-SD of the Reclaimed Configuration Appendix. Findin¢s - The applicant has demonstrated that sediment ponds and/or treatment facilities will function properly to ensure that disturbed-azea drainage will meet the effluent -imitations of 4.05.2 and the applicable State and Federal water quality requirements for downstream receiving waters. The Division has granted small area exemption status from use of sediment ponds to seven areas of the Bowie No. 1 Mine due to the limited size of the areas and due to the fact that ponds and treatment facilities are not necessary for the drainage to meet the effluent limitations of Rule 4.05.2 and applicable State and Federal water quality standazds for receiving streams and also due to the fact that no mixing of surface drainage with a dischazge from underground workings will occur. The small areas to be exempted are the Bowie No. 1 West Mine fill outslopes (north and south), Bowie No. 1 West Mine vent fan site, training trailer area outslopes, the silo azea railroad outslopes, the Bowie No. I main facilities fan area and the south portion of the highway coal stockpile azea. Because of the reclamation activities and the building of two sediment ponds at the West Mine portal bench area, the small area exemptions at the West Mine fill outslopes (north and south) are no longer applicable.
