<br />Benefit Fund and the 1992 United Mine Workers of America Benefit <br />Plan under the Coal Industry Retiree Health Benefit Act of 1992, <br />(3) Fixing Date by which Motions for Reconsideration Must be <br />Filed, and (4) Setting Hearing on Motion for Reconsideration, if <br />any Are Filed, and this Court's Order entered on January 20 <br />Denying Motion (Dated 1/11/93) of the Bituminous Operators <br />Association, Inc. for Reconsideration of the Court's December 17, <br />1992 Order Fixing January 25, 1993 as the Bar Date (collectively <br />these two Orders will be referred to as the "Bar Date Order"). <br />These appeals are currently pending before the Tenth Circuit. <br />(2) The Combined Fund and the 1992 Plan's <br />appeals of the Estimation Order to the District Court are <br />currently pending before the District Court. <br />5. The Combined Fund disputes CF&I Steel's allegations in <br />the Adversary Proceeding and asserts that it has substantial <br />defenses to those allegations. The Combined Fund and the 1992 <br />Plan dispute the allegations contained in the Reorganized Debtors' <br />Claim Objections. The Reorganized Debtors assert that the <br />Confirmation Order, Estimation Order, and Bar Date Order were <br />properly entered and dispute the appeals filed by the Combined <br />Fund and the 1992 Plan. <br />6. In order to avoid the time, expense, and uncertainties <br />of this varied and complex litigation and to settle the disputes <br />between them, the Reorganized Debtors, the Combined Fund, and the <br />1992 Plan have resolved these disputes on the terms set forth in <br />the Settlement Agreement. <br />5 <br />
