Either this year <br />or early next year the Division should determine whether the area <br />should be reseeded, or import topsoil and then reseed, or wait <br />another growing season. If we could tie this reseeding task into <br />the task mentioned in item 6 then we could do it in one bid <br />package. The final item to be aware of is the claims and unpaid debts <br />of Western Slope Carbon to the State of Colorado. The operator <br />owes to the state $157,000 plus interest for unpaid Civil Penalties <br />that accumulated during the permit revocation process. The <br />Attorney Generals Office will most likely be looking at any left <br />over bond monies to satisfy the debt. Additionally, a former <br />attorney for Western Slope Carbon has placed a claim on the left <br />over bond money as a means to satisfy a $1,290.65 + interest debt. <br />These issues will be more relevant once all reclamation work has <br />been completed on the site. <br />According to notes in the file, the Division holds $379,285.05 to <br />preform the above mentioned reclamation tasks. I will do a <br />detailed cost estimate for each project to determine the estimated <br />cost. I would like to get together with you before I leave on my <br />vacation to discuss these items and make sure I am heading in the <br />right direction. Until then, I plan to start resolving some of <br />these issues, and working on the bid packages. <br />5 <br />
