<br /> <br />isolated from the main alluvial water table downstream, and is recharged solely by <br />precipitation. <br />Based on information supplied in the original application, and supplementary <br />information available from the Marr Strip mine permit, it has been determined that <br />there exists no current or historical regional practice of flood irrigating acreages less <br />than 10 acres in size. Therefore, the Division makes the finding that the North Fork <br />of Bolton Draw is not an alluvial valley floor. <br />Bolton Draw <br />Bolton Draw is the major drainage that lies to the east of the permit area. A <br />determination was made in the original permit approval that a segment of Bolton <br />Draw is an AVF. This was based on geomorphic and water-availability criteria, and <br />the potential for flood irrigation. Although there was some question about the <br />potential for flood irrigation and saline soil conditions in this area, a positive AVF <br />determination was made for the segment of Bolton Draw between the stockpond in <br />Section 11, T8N, R78W and the confluence with the Canadian River (see Exhibit 2, <br />Addendum). <br />Information on alluvial valley floors can be found in Volume I, pages 106-116, and <br />Volume IV, Addendum 1 of the original permit application. In addition, information <br />available from the adjacent Marr Strip Mine permit application was used in <br />identifying alluvial valley floors (AVFs). This information can be found in the <br />Division's findings document for renewal of Permit No. C-80-006 dated April' 26, <br />]986. <br />The Division finds that activities proposed by the applicant will not interrupt, <br />discontinue, or preclude farming on the alluvial valley floors that are irrigated or <br />naturally subirrigated (4.24.3(1)) except undeveloped rangelands that are not <br />significant to farming (4 4.3(1)) and 2.06.8(5)(a)(i)) <br />The proposed activities will not materially damage the quantity or quality of water <br />in the surface or groundwater system described above, (4.24.3(3) and 2.06.8(5)(a)(ii)). <br />The proposed activities will comply with the requirements of the Act and the <br />Regulations with respect to alluvial valley floors, (2.06.8(~)(a)(iii)). Surface coal <br />mining and reclamation operations will be conducted to preserve the essential <br />hydrologic functions of alluvial valley floors outside the permit area and to <br />reestablish the essential hydrologic functions of alluvial valley floors within the <br />affected area throughout the mining and reclamation process, (4.24.2). <br />Canadian Strip Mine, C-81-026 27 July 31, 1992 <br />
