13. The Division hereby approves the post-mining land use of wildlife habitat and <br />rangeland. It was determined that the proposed land use meets the requirements of <br />Rule 4.16 for the permit area (2.07.6(2)(1)). The primary land use at the Canadian <br />Strip Mine site was wildlife habitat and rangeland for cattle grazing prior to mining <br />operations. The approved reclamation plan, is to return the land to equal or better <br />utility for these same uses. Post-mining land use will be wildlife habitat and <br />rangeland. <br />Ponds Nos. 1 and 2 are being retained as permanent structures at the mine site, per <br />Technical Revision No. 6, approved by the Division in August, 1991. The <br />O.S.M.R.E. concurred with the Division's approval of pond No. 2 as a permanent <br />impoundment on April 15, 1992. Landowners requested retention of these ponds and <br />filed for the associated water rights, in recognition that the pond's retention would <br />enhance the post-mining land use per Rules 4.16.1(2) and 4.16.2(1). The operation <br />is in compliance with the requirements of this section. <br />14. Specific approvals have been granted. These approvals are addressed in the <br />following section, Section B. (2.07.6(2)(m)). <br />15. The Division finds that the activities proposed by the applicant would not effect the <br />continued existence of endangered or threatened species or result in the destruction <br />or adverse modification of their critical habitats. (2.07.6(2)(n)). <br />16. The Division has contacted the Office of Surface Mining, Reclamation Fees Branch. <br />As of April 21, 1992, the operator is current in the payment of reclamation fees <br />required by 30 CFR Chapter VII, subchapter R.
