XVIII. Rule 4.18 Protection of Fish, Wildlife and Related Environmental Values <br />There are no fish and there is no fish habitat on the site. Impacts to as many as 50 species of <br />mammals, birds, and reptiles are described in the permit, as well as their recovery after <br />reclamation (Application, Sec 2.04.11). There are no known endangered species in the area <br />(Application, Sec 2.04.11 4 B, page 95 and 98). However, this conclusion was reached from a <br />January 4, 1974 Federal Register list. Species discussed include the American peregrine <br />falcon and the black-footed ferret. A list of federally listed Threatened and Endangered <br />Species effective as of August 21, 1996 was obtained from the United States Department of the <br />Interior, Fish and Wildlife Service, Ecological Services, Colorado Field Office. For Weld <br />County, the species are Bald eagle, Whooping crane, Least tern, Piping plover, Eskimo <br />curlew, Mountain plover, Mexican spotted owl, Black-footed ferret, and Ute ladies'-tresses <br />orchid. Candidate species Swift fox and Colorado butterflyweed. Thus a stipulation is <br />included in the renewal for CEC to promptly review potential impacts to the species on the <br />current list. <br />XLY. Rule 4.19 Protection of Underground Mining <br />There were no underground mining activities at the site, and none are planned [Rules 4.19(1) <br />and 4.22.4(1)]. <br />XX. Rule 4.20 Subsidence Control <br />No potential for subsidence exists at the site, thus no control plan is required. <br />XXI. Rule 4.21 Coal Exploration <br />Coal exploration is not a part of the permit, thus the subject of Rule 4.21 is not applicable to <br />the permit. <br />XXII. Rule 4.22 Concurrent Surface and Underground Mining <br />Mining has ceased at the site, and there are no plans to re-initiate mining. In any event, there <br />was no concurrent surface and underground mining at the site. The subject of Rule 4.22 is not <br />applicable to the permit. <br />XXIII. Rule 4.23 Auger Mining <br />There was no auger mining at the site, and none is planned. Thus the subject of Rule 4.23 is <br />not applicable to the site. <br />XXIV.
