The following stipulations were resolved during the third five-year permit term. <br />Stipulation No. 20. Ash material at the Keenesburg Mine must be buried a minimum of eight <br />(8) feet below the final post-mining reclaimed surface [Findings, 1992; Permit, 1991; <br />Technical Revision (TR) 13 (origin, not verified)]. Included in the Permit under Section (Sec) <br />2.05.3, revised page 104, line 25. <br />Stipulation No. 21. Ash material at the Keenesburg Mine must be buried a minimum of five <br />(5) feet above the project post-mining water table [Findings, 1992; Permit, 1991; TR 13 <br />(origin, verified]. Included in the Application under section 2.05.4, revised page 113, line 27. <br />Stipulation No. 28. Provide a revised site map, a new well completion report and well <br />abandonment plans within 30 days of the new well completion. Also provide a well permit <br />application document and Water Resources Division's approval within 30 days of receipt. <br />(This work has been accomplished as of the date of renewal. Materials are to be incorporated <br />into the Permit under a pending Minor Revision.) <br />The following stipulations are were added to the Permit as a part of Renewal Application No. 3 <br />approval and were resolved by the date of this revision to the Findings. This section is <br />relocated from current to resolved stipulations in this revised Findings. <br />Stipulation No. 29. Submit, by August 31, 1997, a Minor Revision that~pdatgupdates <br />Section 2.04.11 as regards Endangered and Threatened Species, inclusive of those Federally <br />Listed species as of 1 June 1997. [CEC complied, under protest, with this stipulation by <br />submission of Minor Revision 30 on (date of cover letter) August 27, 1997.] <br />Stipulation No. 30. Submit, by September 30, 1997, a Minor Revision that provides certified <br />copies [see Rule 2.10.3(2)] of Permit Area Map (Appendix A-1, 03-18-93), and Map, Adjacent <br />Property Owners, 2.03.4 (May 1, 1996). (CEC complied with this stipulation by submission <br />of Minor Revision 31 on September 29, 1997.) <br />Stipulation No. 31. Submit, by October 31, 1997, a Minor Revision that provides current <br />information and a map (certified revision of Land Use Topographic Map and Well Locations, <br />May 1, 1996, of the Permit Application) for water, oil and gas wells as required by Rules <br />2.04.7(1)(a)(iv), 2.04.7(1)(b), and 2.04.7(4)(a & f). (Wells in Sections 11, 12, 13 and 14 <br />Township 2 North Range 64 West are exempt from this stipulation.) (CEC complied with this <br />stipulation by submission of Minor Revision 31 on September 29, 1997.) <br />The following stipulations are in effect as of this review, and are to be included (retained) in <br />the Permit in conjunction with this proposed approval of the Application. <br />Stipulation No. 5. The Permittee shall submit an Annual Hydrology Report by January 30 of <br />each year which presents and discusses the monitoring data collected during the past year <br />[Findings of Permit Renewal 2. 1992; Permit 1986 (origin); Permit 1991]. <br />12 18 February 1998 <br />
