Berry <br />State of Colorado <br />Division of Minerals and Geology <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />~ECEIVEC <br />QCT 3 0 yggg <br />DIV151fjt1 UI MIBCitllti d ©tlbltlgy <br />Re: Signs <br />Dear Mr. Berry: <br />In response to your recent inspection, Oxbow Carbon and Minerals, <br />Inc., Sanborn Creek Mine, proposes the following actions as a <br />practical and reasonable solution to the issues contained in the <br />citizen's complaint of Mr. Dennis Short: <br />Oxbow Carbon and Minerals, Inc. will exercise its rights and <br />responsibilities as a private land owner, unrelated to the surface <br />mining activities incident to the Sanborn Creek Mine and the <br />Colorado Division of Minerals and Geology Permit Number C-81-022. <br />The location of abandonment of Old State Highway 133 will be <br />surveyed and a sign will be posted notifying the public the road is <br />a private road from that point on. <br />The location of the boundaries of Oxbow Carbon and Minerals, Inc. <br />private land along Old State Highway 133, New State Highway 133, <br />and other public roads in Gunnison and Delta Counties will be <br />surveyed and signs will be posted notifying the public the land is <br />private along both sides of the road from that point on. The signs <br />will also notify the public that hunting, fishing, and trespassing <br />is allowed by permission only. The signs will also notify the <br />public that violators will be prosecuted to the fullest extent of <br />the law, at the discretion of Oxbow Carbon and Minerals, Inc. <br />Oxbow Carbon and Minerals, Inc., Sanborn Creek Mine, intends to <br />fully comply with all requirements of the Colorado Division of <br />Minerals and Geology Permit Number C-81-022. Based on an apparent <br />change in policy by the Division in response to the citizen's <br />complaint of Mr. Dennis Short, Oxbow Carbon and Minerals, Inc., <br />Sanborn Creek Mine, will survey the permit area along Old State <br />Highway 133, New State Highway 133, and other public roads in <br />Gunnison and Delta County and permit identification signs will be <br />posted in accordance with Rule 4.02.2. Oxbow Carbon and Minerals, <br />Inc., Sanborn Creek Mine, requests sufficient time to complete the <br />survey work and have the signs made and installed. <br />P O.
