Cattany <br /> <br />Hayden, CO 81639 Division Director <br />Natural Resource Tms[ee <br />Re: Seneca II Mine (Permit No. C-1980-005) <br />Review of Draft Phase I Bond Release Request <br />Dear Mr. Karo: <br />The Colorado Division of Minerals and Geology (CDMG) has reviewed Seneca Coal <br />Company's Draft Phase I Bond Release Request and has the following comments <br />regarding this submittal. <br />Exhibit A does not designate the law under which each area was mined and <br />reclaimed (see Rule 2.10.2). All areas are crosshatched in the same color in <br />Exhibit A. At a minimum, please distinguish when mining and when <br />reclamation occurred for the categories listed below. This may require two <br />maps. <br />• Prior to August 3, 1977. For those lands that were mined and reclaimed <br />under one of Colorado's early reclamation permits, designate the permit <br />number for each area. These are considered pre-law areas. <br />• After August 3, 1977, and prior to May 3, 1978; <br />• After May 3, 1978 and prior to the approval of the applicable regulatory <br />program or issuance of the permanent program permit. (September 23, <br />1981). These are considered interim program areas. <br />• After issuance of the permanent program permit on September 23, 1981. <br />The determination of when surface coal mining operations occurred establishes <br />the reclamation criteria that the lands will be evaluated against. Acreages for each <br />category and for each reclamation block are necessary. <br />2. The dates when reclamation worked was performed is necessary. Since this is a <br />Phase I bond release request, the date when backfilling/grading was completed <br />and when permanent channels were constructed is needed.
