<br />-7- <br />Final Decision <br />Pursuant to CRS 34-33-125(9), the Colorado Mined Land Reclamation Division <br />proposes to approve, in part, the request for bond release at the Meadows <br />No. 1 Mine. The Division is proposing to release bond amounts per the <br />following schedule and requirements. <br />The Division finds, based on the findings contained in this document, that the <br />haul road is eligible for release of that money held with respect to stability <br />issues. This includes costs for total backfilling of the road. Additional <br />bond release on the haul road is not warranted, as the operator has not <br />fulfilled the requirements of Rules 4.03.2(1)(b) and 4.03.2(4)(iv). These <br />rules require the operator to demonstrate that the road does not cause damage <br />to fish, wildlife, or other related environmental values, and does not cause <br />additional contributions of sediment to streamflow or runoff outside the <br />permit area. <br />Rule 3.03.1(3)(d) requires the Division to retain at a minimum, sufficient <br />bond to complete the approved reclamation plan. Pursuant to this rule, the <br />Division has reviewed the original bond calculations and the calculations <br />presented in the Meadows bond release application. The Division finds that <br />the original bonding assumptions, which were based on total reclamation of the <br />haul road, are no longer valid. Therefore the Division has recalculated the <br />bond which must be retained for the remainder of the liability period. These <br />calculations indicate that $270,000.00 is required to complete the approved <br />reclamation plan. <br />In summary, the final decision of the Board rendered on August 28, 1986, is to <br />release $745,340.00, based on the demonstration that the haul road is stable. <br />The Division will retain $270,000.00 in bond for the haul road. <br />srs <br />7442E <br />
