-6- <br />Erosion Control - Significant erosion problems exist at the outlet of <br />several roa~cuTverts, sediment traps, and rolling dips. Five violations have <br />been written by the Division for erosion problems associated with the road, <br />with one of these being issued in the decommission phase. Based on the <br />current erosion problems and off-site impact, the road does not meet the <br />requirements of Rules 4.03.2(1)(b), and 4.03.2(4)(a)(iv). The erosion <br />problems also indicate that the outslope vegetation does not yet meet the <br />criteria of Rule 4.15.10(2). The operator has included erosion control as <br />part of their maintenance program. Progress has been made over the last year <br />in mitigating the erosion problems on site. The Division will continue to <br />investigate this issue until such time that compliance with the applicable <br />regulations can be demonstrated. <br />Post-Mining Land Use (PMLU) - The Division is in receipt of twenty-two <br />letters an numerous p one ca s rom the landowner which voice <br />dissatisfaction with the road pursuant to the post-mining land use. The <br />landowner states that due to problems with snow plowing, the road surface, the <br />rolling dips, and off-site erosion, the intended PMLU cannot be realized. The <br />Division feels that the landowner concerns are essential to the PMLU <br />determination, since in accordance with Rule 2.05.5(1)(a)(iii) the approval to <br />leave structures for the PMLU must be consistent with surface owner plans and <br />programs, and is continuing to investigate these issues. <br />Airfield Reclamation - The landowner has voiced complaints that his <br />airstrip area a ong t e ampa River has been rendered useless due to Sun Coal <br />Company's reclamation activities. Based on the permit application, the <br />approved PMLU for this area is pastureland. The Division finds that due to <br />the extremely rocky conditions which exist on the surface of this reclaimed <br />area, that the PMLU of pastureland has not been met. <br />Slash Piles - The landowner has complained that two areas along the <br />road where s as piles exist preclude the approved PMLU on these areas. He <br />states that these piles are dangerous to his cattle and decrease the area <br />available for grazing area. The operator contends that the piles are small, <br />and provide good wildlife habitat. During field inspections it has been noted <br />that other slash piles exist on the landowner's property which are not <br />affiliated with Sun Coal. The Division finds that the slash piles do not <br />interfere with the approved PMLU, which is grazing and wildlife habitat. <br />Based on these specific findings the Division has issued a proposed decision <br />to approve in part, the bond release request for the Meadows No. 1 Mine. The <br />Mined Land Reclamation Board affirmed the Division's findings and approved the <br />decision as final on August 28, 1986. This dicision is contained in the <br />"Final Decision" section of this report. <br />
