<br />PROPOSED DECISION <br />The Colorado Division of Minerals and Geology proposes to approve, with six stipulations, an <br />application for renewal of a valid existing permit. The permit renewal (RN-04) is for a five year <br />term, and does not entail any increase in permitted acreage or mine plan expansion. The <br />Division is proposing to approve modifications to certain aspects of the approved plan in the <br />context of the permit renewal, including hydrologic monitoring requirements, stream channel <br />reconstniction, and demonstrations of revegetation success. <br />This decision is based on a fording that the operations will comply with all requvements of the <br />Colorado State Program as found in the Colorado Surface Coal Mining Reclamation Act, C.R.S. <br />34-33-101 et seq., and the Regulations promulgated pursuant to the Act. If no request for a <br />formal hearing is made within thirty (30) days of the first publication of the issuance of this <br />proposed decision, then this decision becomes final. Upon submittal of acceptable surety by the <br />applicant, the permit will be issued. The permit application, all supporting documentation and <br />any stipulations or conditions will become a binding part of the permit. The stipulations imposed <br />on the permit as a part of this proposed decision are as follows: <br />STIPULATION NO. 22 <br />d <br />THE PERMITTEE WILL SUBMIT ADDITIONAL BOND IN THE AMOUNT OF $25,147.00 <br />TO THE DIVISION WITHIN THIRTY DAYS AFTER THE PUBLIC COMMENT PERIOD <br />ENDS. THE PERMIT WILL NOT ISSUE PRIOR TO ACCEPTANCE AND APPROVAL OF .~.-a~' t <br />THE BOND BY THE DIVISION. <br />STIPULATION NO. 23 <br />WITHIN 30 DAYS OF PERMIT ISSUANCE, THE OPERATOR WILL SUBMIT A <br />RELEVANT SHOWING STATEMENT IN LIEU OF CERTIFICATION FOR THE MCCLANE ~ . /; <br />ACCESS/HAUL ROAD, PURSUANT TO RULE 4.03.1(1)(d)(ii). <br />STIPULATION NO. 24 <br />TABLE 3.1-1 WILL BE EXPANDED TO ADDRESS THE RECLAIMED CHANNELS IN <br />THE VICINITY OF THE RECLAIMED LOWER ACCESS ROAD AND SEDIMENT <br />POND/TOPSOIL STOCKPILE SITE. RIPRAP SIZING, GRADATION, AND <br />INSTALLATION DESIGN DETAILS WILL BE PROVIDED FOR THOSE CHANNEL J <br />SEGMENTS WHICH REQUIRE RIPRAP PROTECTION, AND RECLAMATION PLAN ~~,_,~ <br />TEXT WILL BE AMENDED TO SPECIFY THAT CONCRETE FROM FOUNDATIONS <br />AND OTHER SOURCES WILL BE BURIED AT LEAST FOUR FEET BELOW GRADE, IN <br />LOCATIONS OTHER THAN THE RECLAIMED CHANNELS. THESE AMENDMENTS <br />WILL BE SUBMITTED WITHIN A COMPLETE TECHNICAL REVISION APPLICATION <br />WITHIN 60 DAYS OF PERMIT ISSUANCE. <br />2 <br />
