CV-2001-010 was issued on 14 May 2001 for failure to ensure that non-coal wastes including <br />grease, lubricants and other flammable liquids were placed and stored in a controlled manner in a <br />designated portion of the permit azea. Specifically, 10 to 12 55 gallon drums and several smaller <br />containers of fluids, including oil, grease and surfactants had been places in a location not <br />approved or designed for such use. The violation was abated with the approval of Technical <br />Revision 55. <br />CV-2002-004 was issued on 27 Mazch 2002 for failure to maintain a sediment ponds primary <br />spillway as necessary to ensure proper functioning in accordance with the approved design. <br />Specifically leakage of pond water into buried culvert at the base of the primary spillway riser <br />allowed for discharge flow estimated at 10-15 gpm at pond RP-2/3. The violation was <br />immediately abated by the Operator and no revision was required. <br />CV-2002-015 was issued on 10 July 2002 for failure to properly water or otherwise manage <br />refuse disposal area working surface to effectively suppress fugitive dust emissions so as to <br />comply with all applicable state and Federal air quality statutes and regulations. This violation <br />applied to RP-Sa. Abatement included the immediate initiation of watering of the refuse pile and <br />continued watering as necessary to control fugitive dust. <br />CV-2002-016 was issued on 11 July 2002 for failure to provide for proper surface drainage <br />during coal mine waste pile construction in accordance with approved plan and applicable <br />regulations. This violation applied to RP-Sa and was abated with the approval of Technical <br />Revision 58. <br />CV-2002-017 was issued on 11 July 2002 for improper ditch construction or maintenance which <br />resulted in erosion of two sediment pond collection ditches and improper ditch maintenance <br />which exposed a buried pipe segment which could have resulted in disturbed azea drainage being <br />routed azound sediment Bond DP-1 and into Scullion Gulch without treatment. Abatement of <br />this violation included backfilling and riprapping the collection ditches to stabilize them and <br />removing the exposed portion of pipe. <br />Blue Mountain Energy, Inc. (BME) submitted an application for a fourth revision of Permit C- <br />81-018 (PR-04), on 24 August 2001. The submittal included a revision application form, <br />proposed public notice, and numerous changes to permit text and maps to bring the permit up to <br />date and eliminate duplication. Substantive changes proposed in the initial submittal included an <br />updated listing of officers and directors and the removal of the loadout loop and associated <br />facilities. With this revision a proposed decrease in disturbed and affected azea was proposed. <br />Permit Revision 04 was combined with the 2001 Midterm Review because many of the issues <br />raised in the midterm review overlapped those contained in PR-04. <br />The application was deemed complete on 27 August 2001 and notices were provided to various <br />
