ANTIQUITIES ACT OF NNE 8,1906, (34 STAT. 225; 16JU.5.C. SECS. 431-433), THE <br />ARCHAEOLOGICAL RESOURCES PROTECTION ACT OF 1979 (PUBLIC LAW 96- <br />95), AND 43 CFR, PART 3, THE OPERATOR SHALL IMMEDIATELY CEASE <br />ACTIVITY AND REPORT DIRECTLY TO THE AREA MANAGER, BUREAU OF <br />LAND MANAGEMENT. THE BUREAU SHALL THEN TAKE SUCH ACTION AS <br />REQUIRED UNDER THE ACTS AND REGULATIONS THEREUNDER THE <br />OPERATOR SHALL FOLLOW THE MITIGATION REQUIREMENTS SET FORTH <br />BY BLM CONCERNING PROTECTION, PRESERVATION, OR DISPOSITION OF <br />ANY SITES OR MATERIAL DISCOVERED. IN CASES WHERE SALVAGE <br />EXCAVATION IS NECESSARY, THE COST OF SUCH EXCAVATIONS SHALL BE <br />BORNE BY THE OPERATOR UNLESS OTHERWISE STATED. <br />STiPili,ATi[lN Nn_ 51 (TR-38) <br />IN ORDER TO PROTECT IMPORTANT SEASONAL WILDLIFE HABITAT (BIG <br />GAME SEVERE WINTER RANGE), EXPLORATION, DRILLING, AND OTHER <br />DEVELOPMENT ACTIVITY MAY NOT BE ALLOWED FOR UP TO SIXTY (60) <br />DAYS DURING THE PERIOD FROM DECEMBER 1 THROUGH MARCH 31. THIS <br />LIMITATION DOES NOT APPLY TO MAINTENANCE AND OPERATION OF <br />EXISTING FACILITIES. EXCEPTIONS TO THIS LIMITATION IN ANY YEAR MAY <br />BE SPECIFICALLY AUTHORIZED IN WRITING BY THE AREA MANAGER, <br />BUREAU OF LAND MANAGEMENT. <br />The Deserado Mine is an active underground coal mining operation located in Rio Blanco <br />County, approximately nine miles northeast of Rangely, along County Road 65, neaz Kenney <br />Reservoir. The initial DMG permit for the operation was issued to Western Fuels-Utah, Inc., <br />(former operator) on July 27, 1981. Facilities construction and underground development were <br />initiated shortly thereafter. <br />Mining operations during previous permit terms have utilized longwall extraction and room and <br />pillar techniques to extract coal from the "D" Seam. "D" Seam mining within the permit azea <br />was completed in 1999, with operations shifting to the underlying "B" Seam, beginning with <br />development mining in 1998/1999, and initiation of longwall extraction in early 2000. <br />The Deserado Permit was previously renewed in Apri12000. Mining operations and schedules <br />were substantially altered by a mine fire in Longwall Pane19, in the northeast portion of the <br />permit area, in January 1996. The entire "D" seam longwall mining district in the northern <br />portion of the pernut area was eventually sealed off, and the longwall equipment was not <br />recovered. <br />
