<br />Mr. Mark A McLean <br />September 22, 1999 <br /> <br />Page <br />expires nn March 31, 2000, and 10.20 acre feel of the total commitment of 18.05 acre feet will be <br />used for a substitute water supply plan for the LaFarge Evans No. 2 Gravel Pit, leaving 7.85 acre <br />feet to ccver Beitramo's replacement water requirements from August t , 199 through March 31, <br />2000. Accordingly, you have requested that this substitute water supply plan should be approved <br />only for the 8-month period through March 31, 2000. <br />As required by Senate Bill 89-120 In Section 8, this substitute water supply plan has been <br />provided to an outside consultant for review. The consultant has recommended approval of the <br />plan by way of a draft of this letter. Based upon statutory requirements and the recommendations <br />of the consultant, I hereby approve the proposed substitute water supply plan in accordance with <br />Section 37-80-120, C.R.S., subject to the follox•ing conditions: <br />A well permit must be issued for the gravel pit in accordance with §37.90.137(2) and (11), <br />C.R.S As noted in your letter of August 3, 1999, the consent of owners of wells located within <br />600 feet of the gravel pit i.s a requirement for issuance of the well permit. This substitute water <br />supply plan is approved subject to the condition that the well permit must be issued before <br />groundwater is exposed in the pit and before any groundwater is pumped for uses associated <br />with this plan. <br />2. The depletions to the Arkansas River associated with the gravel mining operations must not <br />exceed a total of 12.00 acre-feet per year cr 7.85 acre-feet during the first 8-month term of this <br />plan, August 1, 1999 through March 31, 20G0, inGuding categories of consumptive use due to <br />evaporation, dust suppression, water used fcr concrete batchiny, and water lost in product. <br />Should the total consumptive use exceed 7.85 acre-feet prior to the expiration date of this <br />plan, an amendment will need to be filed with this office. <br />3. Releases of water by the Board of Water Works of Pueblo pursuant to this plan shall be <br />coordinated with the Division Engineer znd the Augmentation Coordinator and shall equal Or <br />exceed the depletions to be replaced on a monthly basis. <br />4. Adequate accounting of depletions and repla^aments must be provided to the Water <br />Commissioner and/or Division Engineer on a monthly basis or other interval acceptable to <br />both of them. The accounting of deplerions maybe in a format similar to the attached form, <br />which was provided with your letter of August 3, 1999. In any case, the accounting form must <br />show, at a minimum: <br />A. The categories of consumption shown in the attached form, <br />B. Total actual monthly depletions to be replaced (monthly and cumulative year-to-date), and <br />C. The amounts of replacement water released by the Board of Water Works of Pueblo to <br />replace the depletions due to the 8elframo Mine Pit (monthly and cumulative year-?o-date). <br />5. The accounting form(s) shall be sufficient to demcnslrate that the net effective replacement <br />equaled or exceeded the total depletion on a monthly basis. All replacement water must be <br />concurrent with depletions in quantity, timing ar~d Iccaiion, except that releases may be <br />aggregated at the discretion of the Division Engineer or the Augmentation Coordinator. <br />6.
