N III IIIIIIIIIIIII III ~ <br />~~ECEIVEQ <br />Wl - S ~ - (43 November 18, 1994 NOV 2 3 1994 <br />Gunnison, CO 81230 <br />Division of Minerals 8 Geology <br />Mr. Bruce Humphries: <br />Received your certified letter dated October 26, 1994 on November 1, 1994 with the Notice of <br />Determination that you have designated the Gold Link as a mining operation. I wish to appeal this <br />decision with this letter and also state the reasons I disagree with the Board's decision. <br />1. This mine has not been mined since we permitted it in 1987. All that has been done <br />is some drilling for samples and an exploration program to decide if they were good <br />enough to warrant the cost of a mining operation. <br />2. We have not been on the property to do any work since 1991, three years. <br />3. The water samples taken by Robert Oswald of MLRB, sent to EPA show the water is <br />very good quality, also we had Mark Templeton of the Gurmison County Sanitation <br />Department take samples which he sent to the Grand Junction lab. These samples <br />show the water to be very good. The ph is 7.5 and 7.6 as stated and is non-toxic or <br />acidic. <br />4. In our permit No. M87-143, we state that we may haul some of the tailings to be <br />milled. It does not say we will, as you state in paragraph 2 of your letter. We <br />sampled the tailings pile and it does not contain enough metals to pay for a mining <br />and milling program, so we will not disturb it. <br />5. The tailings pile has no mine water through it or near it as the tailings pile is 300 feet <br />from the dischazge point. The waste rock pile by the portal consists mostly of plain <br />rock and the mine discharge water is piped away from it. <br />6. There are no chemicals used or stored on this site. In summary we have no plans to <br />ever mine the Gold Link from this portal or to disturb the tailings pile which <br />has been in place since 1912 with no adverse effect on the water. 1 think the best <br />thing to do is to change the designation of the mine back to anon-mining <br />operation. We would clean it un and make it a safe area.
