VII. Disposal of Excess Spoil <br />This section does not apply to the Bowie No. 2 Mine permit application. All excess <br />material generated during surface construction or during underground mining is <br />considered to be coal mine waste, and such materials will be placed in the approved coal <br />mine waste bank. <br />VIII. Coal Mine Waste Banks <br />A. The Division approved plans for use, construction and maintenance of a coal mine <br />waste disposal area (4.10.1(1)). <br />B. The applicant has not submitted a plan for disposal, at the approved disposal azea <br />within the permit boundary, of mine waste materials generated by activities <br />outside the permit boundary (4.10.1(2)). <br />C. The disposal area will be inspected on a regulaz basis by a qualified professional <br />engineer, experienced in construction of similar earth and waste structures <br />(4.10.2(1)). <br />D. An alternative subdrainage system for the coal mine waste area has not been <br />proposed. The Division finds that the approved subdrainage system should ensure <br />the applicable static safety factor, stability of the fill, and protection of the surface <br />and ground waters (4.10.3(5)). <br />E. The Division is not proposing to approve a variation in the requirements for <br />maximum allowable lift thickness and minimum required compaction <br />(4.10.4(3)(a)). <br />IX. Coal Mine Waste <br />A. Non-coal waste will be stored at designated locations at the mine site, then <br />transported to the Delta County landfill for proper disposal. <br />X. Backfilling and Grading <br />A. BRL will reclaim the mine site to achieve approximate original contour. All <br />highwalls will be eliminated during reclamation. BRL has not requested any <br />variances regarding backfilling and grading, nor are any approved with this <br />decision document. <br />XI. Revegetation <br />Information regazding baseline vegetation studies may be found in Section 2.04.10 of the <br />permit. Information regazding revegetation of disturbed areas may be found in Section <br />2.05.4 of the permit. The goal of revegetation efforts at the Bowie No. 2 Mine is to <br />32 <br />
