r <br />a larger drainage area into the pond than was anticipated by the 1986 design. <br />More information can be found in the Stipulation Resolution File. <br />Stipulation 7 <br />PREPARE A REQUEST FOR REMOVAL FOR POND 004 OR BRING THE <br />EMBANKMENT IN COMPLIANCE WITH 4.05.618-1e) AND (g) BY AUGUST 15, <br />1991. <br />Status: Complied with August 19, 1991. This stipulation was added to the permit <br />upon approval of Technical Revision 7, which addressed various issues as a result <br />of the Mid-Term review. During the Mid-Term review, it was noted that pond 4 did <br />not meet the requirements of Rule 4.05.618)le) and (g), now Rule 4.05.6111)(e) <br />and Ih) upon Rule revisions completed June 30, 1991. These rules require the top <br />of the embankment be 1.0 foot above the water surface in the pond with the <br />emergency spillway flowing at the designed depth and the minimum top width of <br />the embankment be no less than the quotient of (H + 35) 15 where H, in feet, is <br />the height of the embankment as measured from the upstream toe of the <br />embankment. The stipulation was satisfied upon receipt of a #4 Sediment Pond <br />Certification which detailed the work completed to bring the pond into compliance. <br />More information can be found in the Stipulation Resolution file and the Technical <br />Revision 7 file. <br />Stipulation 8 <br />SUBMIT DOCUMENTATION WHICH DEMONSTRATES THAT THE HUBBARD <br />CREEK ALLUVIAL WELL HAS BEEN ABANDONED IN COMPLIANCE WITH RULE <br />4.07.3 BY AUGUST 15, 1991. <br />Status: Complied with August 19, 1991. This stipulation was added to the permit <br />upon approval of Technical Revision 7, which addressed various issues as a result <br />of the Mid-Term review. This stipulation was satisfied upon receipt of a <br />certification describing the method used to abandon the alluvial well.
