Stipulation 2 <br />BLUE RIBBON COAL COMPANY SHALL REVISE EXHIBIT F OR OTHERWISE <br />AMEND THE PERMIT APPLICATION TO ENSURE PROTECTION OF ESTABLISHED <br />RIPARIAN VEGETATION ADJACENT TO POND 1. A REVISED EXHIBIT F OR <br />OTHER AMENDMENT DEMONSTRATING PROTECTION OF THE RIPARIAN <br />HABITAT MUST BE SUBMITTED TO THE DIVISION WITHIN 30 DAYS OF PERMIT <br />ISSUANCE. <br />Status: Forgiven September 24, 1984. This stipulation was added to the permit <br />document upon permit approval in 1982. MLRD originally requested than an area <br />of approximately 1 acre near Pond No. 1, be protected. This area was going to be <br />disturbed because of backfill requirements for stabilizing the lower mine bench. It <br />was determined upon completion of the final reclamation slope design that fill was <br />unnecessary in this area and therefore, Blue Ribbon would not disturb the riparian <br />vegetation. In August 1984, a technical revision to reconstruct the mine bench <br />was submitted. The bench reconstruction was deemed necessary to ensure the <br />long-term stability of the site and required disturbance of the area originally <br />protected in this stipulation. Without reconstruction, abench failure could affect <br />this site anyway. Therefore, the Division granted a variance to Blue Ribbon Coal <br />Company to disturb the riparian vegetation zone along Pond No. 1 and nullified <br />Stipulation 2. More information can be found in the Stipulation Resolution file. <br />Stipulation 3 <br />BLUE RIBBON COAL COMPANY SHALL PROVIDE AN ACCEPTABLE STABILITY <br />ANALYSIS OF THE PROPOSED BACKFILLED CONFIGURATION OF ALL MINE <br />FACILITIES AND THE HAUL ROAD, INCLUDING AN APPROPRIATE MATERIAL <br />SHEAR STRENGTH TESTING REPORT. THIS STABILITY ANALYSIS SHALL <br />DEMONSTRATE COMPLIANCE WITH THE STATIC SLOPE SAFETY FACTOR <br />REQUIREMENTS OF RULE 4.27.4(1-. THIS ACCEPTABLE STABILITY ANALYSIS <br />SHALL BE SUBMITTED TO THE DIVISION WITHIN 60 DAYS OF PERMIT <br />ISSUANCE. <br />Status: Complied with January 10, 1983. This stipulation was added to the <br />permit document upon permit approval in 1982. A report was submitted on <br />February 14, 1983, however more information was required in order to satisfy the <br />stipulation. Many alternatives were presented in the analysis and the Division <br />requested a commitment to an alternative that would be used for reclamation. <br />Also required were; cross-sections and plan view maps of the mine bench, <br />backfilling and regrading plan, plans for reclamation of the haul road, and a <br />commitment to install and monitor ground water monitoring piezometers and slope <br />stability monuments. Blue Ribbon complied with this stipulation by providing the <br />Division with; documents to indicate partial backfilling of the portal cut bench and <br />the regrading of the portal bench fill to reduce the outslope gradient, an <br />approximate original contour reclamation configuration for haul roads, and a <br />
