Enclosed are copies of Stormwater Discharge Permits for <br />the four pits. Pits 1 and 4 have stormwater as part of <br />NPDES permits. Pits 3 and Red Shale 1 are stormwater <br />only. In Addition, the Stormwater Management Plan <br />Certification for Pit 4 is enclosed. This certification <br />is not due on the other pits until later this year. <br />2. The processing facilities adjacent to Pit 1 in Delta and <br />Pit 3 in Paonia existed in their present location and <br />function well before there was any mining on adjacent <br />property, They are part of our concrete and sales yard <br />operations. They are on land that has not and will not <br />be mined, These processing areas will not be reclaimed <br />when the adjacent mines are reclaimed because they are <br />industrial sites that will retain their present function <br />regardless of where the material comes from. The <br />processing site in question at the Delta Plant is <br />identified on page 7, paragraph 2 in the mining plan for <br />Pit 1. The stockpile site in question at the ready-mix <br />plant in Paonia is identified on page 6, paragraph 1 in <br />the mining plan for Pit 3. Both these sites are <br />identified in our permits and therefore were approved by <br />the Board when the permits were approved. These sites <br />have always handled material from various locations. I <br />have enclosed a letter from Delta County stating that <br />these sites are in compliance with County regulations. <br />I also have enclosed a letter from Jack Starner to MLRD <br />from March of 1985 in which he restates the separate <br />nature of the process area.
