<br />2 <br />been inspected by numerous MLRD personnel including a <br />Board member. No mention of a conflict with these sites <br />is made in the inspection reports. In fact, HH Posey <br />states in his inspection report of Pit 1 on 1/9/92, that <br />"Processing facilities are adjacent to the pit but are <br />considered an industrial facility.". I have enclosed <br />copies of these inspections for your reference. These <br />sites are identified in our permit as being separate <br />from the permit area and this was subsequently approved by <br />the Board. Therefore, we feel that no violation exists. <br />3. Reclamation costs for Pit 3. <br />Mining is carried on in the Stage I area within the banks <br />of the aggrading North Fork of the Gunnison River. Some <br />of the Stage II area has become part of the river bed also <br />as the river has washed away some of the north bank during <br />spring floods. The part of Stage II that is not within <br />the river banks has not been disturbed and we will not <br />disturb it, therefore it needs no further reclamation. <br />The part of Stage I and II that is within the river banks <br />is shaped and graded annually as it is mined and is then <br />reclaimed by annual spring floods as specified in our <br />approved reclamation plan. The remainder of Stage I is to <br />be a large, relatively flat plain adjacent to the river <br />with a sloped bank around the perimeter. This area <br />already exists in its final grade and shape and requires <br />additional grading only on the perimeter slopes. The <br />Stage III area may or may not be excavated to create a <br />small pond according to the mining and reclamation plans. <br />At this time we have not and do not intend to create this <br />pond, but will include this area in calculation of <br />reclamation costs. <br />Grading: This consists of approximately 1800 linear feet <br />of bank that is 4 to 8 feet high including banks around <br />the pond if created. If we assume it is all 8 feet high <br />and is sloped at 3:1 as described in the reclamation plan, <br />the graded area will be 24 feet wide and the total area to <br />be graded is just under 1 acre. After checking with local <br />contractors, we found that this work can be contracted <br />for $500 or less. <br />Revegetation: The reclamation plan calls for following <br />Soil Conservation Service recommendations in Exhibit H <br />which state that Russian Olive and Cottonwood trees are to <br />be planted only on bank slopes. The reclamation plan <br />indicates approximately 135 Russian Olive and 16 <br />Cottonwood trees in these slope areas. We intend to <br />use 4-H Trees obtained through the Colorado State Forest <br />
