-~ ,- <br />• RECORD OF PROCEEDINGS <br />MINUTES OF THE REGULAR MEETING OF THE BOARD OF UIRf.CTORS OF TIIE <br />FOUNTAIN MUTUAL IRRIGATION COMPANY, DULY AND REGULARLY CALLED <br />AND HELD IN FOUNTAIN, EL PASO COUNTY, COLORADO ON THE 14TH llAY <br />OF FEBRUARY, 1985 AT 3:14 P.M. THEREOF <br />The meeting was called to order by President Prevn-:t wiCh <br />Directors Neuge6auer, Scheierman and Hecox present. Director <br />Johnson was absent. Also present were business manager Farshall <br />and Superintendant Cline. Several representatives oC Castle <br />Concrete were present. <br />The motion was made, seconded and passed to approve the <br />minutes as presented. <br />The motion was made, seconded and passed to pay the bills <br />as presented. Passed. <br />Leigh Whitehead, the engineer for Castle Concrete and Transit <br />Mix presented a plan to parallel Academy Boulevard on the Cast <br />and re-connect to the existing ditch with 2 45° bends after going <br />under Academy. Mark Heffner of Castle Concrete and Transit Mix <br />who is in charge of mining and reclamation stated that 6 inches <br />of topsoil would be put on the ditch banks. They would then <br />seed it and cover it with straw. This measure should prevent <br />erosion. <br />The motion was made seconded and passed to approve the pro- <br />posed alignment with the following conditions: <br />a) An indemnification agreement will be drawn up proCecting <br />The Fountain Mutual Irrigation Company against 3rd party claims <br />during construction. <br />b) Our two companies will legally exchange deeds granting <br />a 60' right of way and abandoning the present right of way. <br />c) Castle Concrete must show proof of the right to cross <br />Academy Boulevard and the power line. <br />d) Castle Concrete will line the ditch with concrete in <br />the existing canal from the pipe along Drennan to the proposed <br />re-alignment. <br />e) Castle Concrete will provide Fountain Mutual with a <br />guarantee that there will be no loss of water during construction. <br />f) All construction will be done according to the plans <br />presented Go Fountain Mutual 6y itr. Whitihead on the above date. <br />There being no further business before the Board, the meeting <br />was adjourned at 4:27 p.m. <br />Ann Marshall <br />Business Manager <br />
