Please delineate the <br />acreage of affected land, and that land involved in right-of-way <br />easements. <br />RESPONSE: The 34.7 acres included in the amendment includes the <br />easement for the ditch. This easement must be included in the permit as <br />affected land because it has been previously mined. It has not been <br />released and is in the process of reclamation as an irrigation ditch. <br />The ditch sides have been seeded and are in the process of revegetation. <br />Therefore, until it is actually released from bond, it must be included <br />in the affected land acreage due it its history of being affected land <br />since the effective date of the law. <br />
