- 14 - <br />TCC has presented a grazing plan in Section 2.05.5 of the permit application. <br />Once revegetated areas are adequately established, the permittee will make the <br />demonstration required by Rule 4.15.5(2). <br />This section is in compliance. <br />XI. Fish and Wildlife - Rules 2.04.11, 2.05.6(2) and 4.18 <br />A discussion of fish and wildlife and their habitats is found in Sections <br />2.04.11 and 2.05.6 of the permit application. All lands associated with the <br />Fish Creek Tipple have been previously disturbed and therefore no new impact <br />to wildlife or their habitat is anticipated. <br />No threatened or endangered species or their critical habitat were identified <br />within the permit area. <br />This section is in compliance. <br />XII. Prime Farmland - Rule 2.04.12. 2.06.6 and 4.25 <br />The Division has made a negative determination for the presence of prime <br />farmland within the proposed permit area. The Soil Conservation Service does <br />not classify any soils with in Routt County as prime farmlands because of cold <br />temperatures and short growing season. <br />The Division finds the operation in compliance with this section. <br />XIII Operations Description -Rules 2.05.2, 2.05.3(1), 2.05.3(2) 2.05.3(3 <br />As described in Section 2.05.3 the Fish Creek tipple/loadout will crush, <br />stockpile and loadout coal produced from the Twentymile Coal Company's Foidel <br />Creek Mine, Permit No. C-056-82, an underground mine six miles southwest of <br />the tipple. The tipple can crush approximately 500 tons of coal per hour. <br />The crushed coal is then stockpiled and conveyed to overhead bins above the <br />railroad tracks. As rail cars pass beneath, the coal can be loaded at a rate <br />of approximately 2,000 tons per hour. No surface or underground mining is <br />proposed. <br />This section is in compliance. <br />XIV. Explosives -Rules 2.05.3(6)(a) and 4.08 <br />No blasting is proposed in this permit application and therefore the <br />requirements of this are not applicable. <br />
