Findings on Protection of Hydrologic Balance <br />All of the observed hydrologic impacts aze consistent with those predicted in the Probable <br />Hydrologic Consequences section of the permit application and the Division's Animas River <br />Cumulative Hydrologic Impact Assessment. Based on the foregoing observations regarding <br />hydrologic impacts, the Division finds that Oakridge has minimized disturbance of the hydrologic <br />balance in the mine plan and adjacent areas, and prevented material damage outside the permit area. <br />The Division also finds that Oakridge has not caused hydrologic changes that adversely affect the <br />approved postmining land use in the permit azea. <br />Findings on Completion of the Reclamation Plan <br />Oakridge requested Phases I, II, and III (final) release for an approximate 61.21-acre bond release <br />azea, The Division reviewed the bond release application, the mine permit, and inspected the lands. <br />Based on the review and inspection, the Division finds that in the bond release azea, Oakridge has <br />successfully completed all surface coal mining reclamation operations in accordance with the <br />approved reclamation plan and fully met all reclamation requirements of the Rules and the Act. <br />Application of Bond Release Phase Limits to Bond Release Request <br />The total amount of bond applicable to the bond release azea is $150,416. Phases I, II, and III bond <br />release is being requested for the bond release azea. Section 3.03.2 does not limit the amount of <br />bond that may be released in a Phase III release; therefore, the entire dollaz amount applicable to the <br />bond release azea is eligible for bond release, assuming all other bond release requirements aze met. <br />V. PROPOSED DECISION <br />Based on the findings set forth above, the Division proposes to approve Oakridge's request for <br />Phases I, II, and III bond release of the bond release azea. The amount proposed for release is <br />$150,416 of reclamation liability. There is no reclamation work remaining to be done in the bond <br />release azea under permit C-92-080. The bond release azea will remain secured by bond under gravel <br />mining and reclamation permit M-1992-116. This proposed decision will release Oakridge from <br />liability for all reclamation work in the bond release area under the Colorado Surface Coal Mining <br />Reclamation Act, and the Regulations of the Colorado Mined Land Reclamation Boazd for Coal <br />Mining. <br />The currently approved permit azea acreage is 225.40 acres. The Division proposes to release 61.21 <br />permit area acres from its jurisdiction. The remaining permit area acreage would be 164.19 acres. <br />The currently approved disturbed area acreage is 156.00 acres. The Division proposes to release <br />21.49 disturbed area acres from its jurisdiction. The remaining disturbed area acreage would be <br />] 34.51 acres. <br />The Division currently holds a reclamation bond from Oakridge in the amount of $816,526. Current <br />reclamation liability is $960,325. The Division proposes to release $150,416 of the reclamation <br />liability, leaving bond and reclamation liability of $816,526.
