Stipulation 6 <br />MINREC SHALL SUBMIT REWORKED POND SIZING CALCULATIONS FOR POND 005 WHICH <br />REFLECT THE INCREASED DRAINAGE AREA SHOWN BY EXHIBIT H-1 BY MARCH 29, 1991. <br />Status: Complied with April 4, 1991. <br />Stipulation 7 <br />PREPARE A REQUEST FOR REMOVAL FOR POND 004 OR BRING THE EMBANKMENT IN <br />COMPLIANCE WITH 4.05.6(8)(e) AND (g) BY AUGUST 15, 1991. <br />Status: Complied with August 19, 1991. <br />Stipulation 8 <br />SUBMIT DOCUMENTATION WHICH DEMONSTRATES THAT THE HUBBARD CREEK ALLUVIAL <br />WELL.HAS BEEN ABANDONED IN COMPLIANCE WITH RULE 4.07.3 BY AUGUST 15, 1991. <br />Status: Complied with August 19, 1991. <br />Summary: All stipulations added to the Blue Ribbon permit as of this date, <br />have been complied with or forgiven and require no further actions. <br />Summary <br />The Review Process <br />The original permit for the Blue Ribbon Mine was obtained by Sunflower Energy <br />Corporation in 1977. The application was submitted in November 1976, amended <br />in August 1977, and subsequently approved later in 1977. <br />Sunflower Energy Corporation submitted a permit application to comply with the <br />provisions of the Colorado Permanent Program requirements on February 17, 1981. <br />This application was found to be complete on February 27, 1981, and the <br />Division's Preliminary Adequacy Review comments were sent to the operator on <br />April 23, 1981. On May 20, 1981, the Blue Ribbon Coal Company succeeded <br />Sunflower Energy Corporation as operator of the Blue Ribbon Mine. <br />Blue Ribbon Coal Company was a Colorado Partnership. The partners included <br />Hawk Mining, Inc., North Fork Energy Corporation, and Cedar-Crest. Western <br />Associated Coal Corporation managed the partnership's business. <br />Blue Ribbon Coal Company submitted the Preliminary Adequacy Review response on <br />October 8, 1981. Additional review comments were forwarded from the Division <br />to the operator on November 30 and December 4, 1981, and the Division received <br />responses from Blue Ribbon Coal Company on January 5, 1982, May 17, 1982, and <br />July 27, 1982. These responses satisfied issues raised during the review <br />processes. The final decision to approve the permit application was made <br />December 8, 1982. <br />3- <br />
