Johnston <br />Division of Minerals and Geology <br />1313 Sherman St., Room 215 <br />Denver, CO 80203 <br />Re: Terror Creek Company <br />Diesel Fuel Spill <br />Permit No. C-83-059 <br />Dear Ms. Johnston: <br />MAY 18 1gg5 <br />Division or Nnnerais a Geology <br />Terror Creek Company has a 6,000 diesel fuel tank on the loadout <br />site. The tank is located within an area that is surrounded by an <br />earthen berm. The earthen berm containment is approximately 75- <br />feet long by 15-feet wide and approximately 2-feet deep. The <br />volume of the containment is large enough to hold the entire volume <br />of the 6,000 gallon tank. <br />Sometime during the weekend of May 13th & 14th, a hose on the <br />diesel fuel tank ruptured and about 4,500 gallons of diesel fuel <br />leaked into the containment. The spill was discovered Monday <br />morning May 15th. TCC has taken the following actions regarding <br />the spill: <br />1) The free product in the containment has been pumped into a <br />spare 6,000 gallon tank. Approximately 2,500 - 3,000 gallons <br />of free product was recovered. <br />2) The CDOH Hazardous Materials Division was notified of the <br />spill (Janet Jones 303-756-4455). Ms. Jones directed my call <br />to the Oil Inspection Section since they did not have any <br />regulations regarding spills into a containment. <br />3) A message was left with the local office of the CDOH Hazardous <br />Materials and Waste Management Division (Donna Stoner 970-248- <br />7168). Ms. Stoner was provided details of the spill later in <br />the day. She was going to check to determine if her office <br />has regulatory authority regarding the spill. <br />4) The CDOH Oil Inspection Section was notified of the spill <br />(Alice Garcia 303-620-4300). Ms. Garcia informed me that the <br />spill was "reportable" (more than 25 gallons) and asked about <br />the details of the spill. I gave her the details and she <br />
